That's what I suggested upthread. The board should sue him civilly, and order discoveries. Therefore Busty will be ordered, to be examined by a doctor.
What if it's found out that Busty Lemieux was lying. Would the board still have to pay damages??

We don’t know whether Lemieux’s medical leave has anything to do with her boobs. She was off work since November with a foot injury and this may be the reason that she is still off now. If that’s the case and her medical leave has nothing to do with her boobs then it doesn’t matter if she’s lying.
So I think it depends on why she is off on medical leave. If she is claiming that her gigantomastia is the cause of her inability to work then she would need a doctor’s note confirming this; but we already know that she does not have a note because that’s what she told the NY Post. Thus, I doubt that’s the reason she is off.
Thus, my guess is that her medical leave is based on either:
1. The foot injury;
or
2. Adjustment difficulties related to her transition (ie a mental health issue) and if this is the reason then it doesn’t matter if she has real giant boobs or not because if she believes that she has non-existent boobs that would be consistent with an adjustment disorder/mental health issue.
Either way, I don’t anticipate a doctor will be inspecting Lemieux’ boobs any time soon and, if I was going to bet on the cause of the medical leave my money would be on the foot injury.
Dress codes are really difficult because you have two choices and both can be fucked with if someone deliberately wants to fuck with them.
One - list EVERYTHING you think needs to be there, or otherwise put some very serious limitations.
This has the problem that people mostly hate it if it is too restrictive (everyone in a uniform) and it almost always means something gets left out, because you can't think of everything. Then someone who wants to fuck with it just works to the loopholes and you have to deal with shit all over again.
Two - go for some vague general sense like "professional", "appropriate", and so on.
This has the problem that it isn't strictly defined so you can end up with fights over what is appropriate or not and why.
The simple fact is that if someone is determined to fuck with the system and dares you to crack down on them, you can't do much about it. Either crack down on them and face the backlash (either in public or the lawsuit) or ignore them and deal with them giving a fuck you to the code.

This problem traces back to the fact that somehow the HDSB has no dress code policy whatsoever at this time; and they can’t simply impose one in the midst of collective bargaining.
I don’t think Lemieux could pass any dress code of any sort in any organization anywhere; but if an organization has nothing whatsoever in place then this is what can happen.
