Maurice I do not agree with your assessment of this trade. To me it is a win for both teams. Phaneuf will be in a better position in ottawa to succeed and I think he will. Toronto wanted to dump him and free up cap space so that is good for them. Only thing that worries me for Ottawa side is the last two years on the deal. I am a Habs fan so no bias for either organization.

He's probably a 5.5-6 million dollar player making 7 I believe and still a point every 2 games player, overpaid but not grossly. Might actually flourish in the new role. Stamkos numbers are way down this year, maybe 30-35 goals this year, and not a great playoff last year and the leafs and their fans are drooling to sign him for 10 mil plus.

So you're thinking Stamkos should sign a contract contrary to the CBA, hoping that it will not contravene a future CBA?

The Toronto fans and media were unfair to Phaneuf. We were expecting the second coming of Bobby Orr or at least Karlson (Leafs could have should have drafted him). Dion is a good defenseman just not in the top tier.

Ummm.... Baseball has always had out clauses and they are permitted. Remember AJ Burnett?

Out clauses are not permitted under the current Hockey CBA. And you can't sign a contract with one now hoping it will change. The contact would be invalid and not registered with the league.

I'm sorry if my post came across as Stamkos signing a contract contrary to the CBA that wasn't my intention and after reading it I undrerstand how you would come to that conclusion. I was simply stating that maybe the out clause should be discussed at the next CBA talks.
Andy Messersmith of the Los Angeles Dodgers and Dave McNally of the Montreal Expos were the first official free agents in baseball. ( sorry Curt Flood ) so i'm just saying that it could be brought up in the next CBA.

I think it is much harder to have an out clause in hockey than baseball because of the cap. I know there is some formula to determine how much towards the cap a contract counts so that if there was an opt out and the contract not fully completed, then the calculations for the previous years would most likely now be incorrect. I suspect it would be possible to have a scenario whereby a contract ends early and if there is a recalculation a team may have been over the salary cap. And what if they'd won the Cup under that situation?

It doesn't matter in baseball. No cap.

They do it's call revenue sharing, If a team goes over the budget then they have to pay a luxury tax to small market teams.
The Yankees paid enough tax to pay for the entire Milwaukee Brewers pay roll.

I think the NHL should do away with the cap and do what MLB does with the Luxury tax.
