The reason the insurgency in the Donbas was so hard to put down was because Russia was sending arms, equipment, ammunition, and straight up soldiers. There's a reason most insurgencies are handled by police but this essentially became a civil war. Civilians don't have access to mortars, tanks, artillery, anti-aircraft weapons, etc. And even if people from the military join the insurgency, the Donbas was cut off and isolated from Ukraine and there wasn't enough missing equipment to sustain it for 7 years. Besides, members of the Russian Duma have confirmed at least 50,000 Russian military service members participated.

If there was confirmed evidence of Ukrainian soldiers engaging in war crimes, like we have of Russia's war crimes, the ICC would be prosecuting them like they did with Russia. Why? But Russia didn't withdraw until after Putin was indicted, which is why the ICC had authority to indict him at the time. Ukraine has not withdrawn, they are subject to the authority of the ICC.
