Sharpiegate could be resolved in 10 minutes. Take a thousand ballots. Mark them with sharpies exactly 1/2 for Biden and 1/2 for Trump. Run them through the tabulator and see what happens. If they all are counted, and come out 50/50, sharpiegate goes "poof". But instead, election officials prefer to go to court and argue "trust me, there is no problem". Sounds like a waste of taxpayer dollars compared to a simple audit.
Yes, round one. My post was pointing out how a practical resolution would have eliminated the need to occupy the court's time.

I thought the evidence was that manufacturer said the machines had been designed to record sharpies. I'm not aware of what field testing took place once the machines were installed.
