The statute of limitations did exceed in the civil case but the ASA made this possible.

Words do matter. The verdict form was written in New York State in a manner that gave the jury choices.

In this case, the jury could feel the plaintiff was harmed to some degree and suffered emotionally. They could award her money without being forced to rule on rape decades after the incident. If the verdict form forced the jury to deliver a verdict on rape without the option of sexual abuse, we have no idea what their ruling would be.
