Who is to say if the driver was 100% sober he might have been able to brake and stop in time or not hit the guy so hard.
Unfortunately many cyclists put themselves in great danger by running red lights etc. in the hopes that motorists will avoid a collision with them when they break the law. If you play chicken with a vehicle, you're going to lose so why would you assume every driver is 100% sober and paying full attention, 100% of the time. It's your life.

Sounds like this never would have happened if the cyclist obeyed the red light. Driver turned himself in and has since been charged. Cyclist is still dead.

Cause most drivers do not drink and drive and they can stop or turn at the very last second...not just plow right in to the idiot who runs a red light.
You're telling me a driver, travelling along Davenport through a green light, at night is supposed to be able to see and avoid a cyclist zipping down the hill through a red light and into his path?

I remember when I was a kid you couldn't ride you bike a night without a working light and a tail light. Had to have 2 generators, one on each wheel. None of this reflector crap. Also we were taught the rules for cyclist on the road at public school.

Now we don't know what happened, but if he was riding a bike chances are he was acting like most cyclist do, running through red lights and stop signs, pulling up on the right hand side of a car, passing them to get to the intersection first and just keep rolling on.

If your a cyclist, you are sharing the road with idiots who can't drive, don't expect to get to your destination safely, be defensive in how you cycle. Remember, I'm in a car and unless you can see my tail lights, your just road kill and don't even know yet.


If I were to drive my car on the 401 like most cyclist ride on the streets of Toronto, I'd have been killed by a transport years ago.

And the fact that i have no clue what happened in this particular incident.

I've cylcled a lot. In busy urban, suburban, and rural roads. I do get pissed when drivers are aggressive, thus risking MY life, however these idiots are few.
To get around successfully in the city on a bike.
Expect the unexpected. Don't take a right turn beside a car or truck, if they cut it too close and don't see you, you are done.
Exert your right to space on the road. Don't ride in the gutter, where you are 3" from the curb. Give yourself a buffer.
Anticipate what drivers are going to do, pull out, open doors etc.
Do obey the rules. Dont run light, stop or at least almost stop at stop signs. Don't ride on the sidewalk, and if you have to, do slowly and always give way to pedestrians.
Wherever possible, take back streets, avoiding busy traffic.

By doing this I've ridden several thousand km over the last decade and a half, without and major incident, not even a significant near miss. Be controlled, let the drivers know what you ate doing.
Couldn't agree more. I both drive and cycle but I use my head when I cycle and don't put myself at risk like all the idiot cyclist I'm constantly avoiding when I drive.

I wonder how much jailtime this Miguel Oliveira is looking at. He seems fairly young and now he's pretty much ruined his life

He should have been braking on impact, IMO. Yes you are to pay 100% attention while driving through any intersection...the most likely place to have an accident.

People make errors on the roads, there has been times where I had to brake when I had the right of way to avoid or lessen the impact. Once I T bone a little sunbird with my big old hot rod car. She was waiting to turn and somebody stop and waved her in, not seeing me in the right lane zipping up to the light so I could turn on red. I hit the brake but still hit her car BUT she walked away from the crash...if I didn't hit the brake, she would have been in bad shape. Guess what, I was 100% sober.

I don't feel too sorry for this guy would could not even brake a bit and just keep on going. He ran cause he had something to hide.,,if he didn't well too bad, it sure looks like it now. He likely was partying all night long on who knows how many different drugs..was he on his way to work or home to go to sleep ? That I love to know the answer to.

You try to prove how smart you are all the time and what a great legal mind you are... yet you "forget" that murder is a deliberate act or it is the death caused during the commission of other specified criminal acts?
oh, and BTW, there is no such charge of "vehicular manslaughter" in Canada.
If this were a boxing match, the ref would stop the fight to save rockslinger from further punishement.

The accident happened at 6:30 AM. I think we can safely assuming the following 2 scenarios:

1. Hit & run driver was early bird on his way to work.
2. Hit & run driver was piss drunk.

I know there's lost of other possible scenarios, but I think those 2 are most likely

I bike on the sidewalk. I'd rather get a ticket than be killed.
That's fine but at some point you're going to have to cross an intersection. If you do it against a red light without looking, you're going to get smoked!

it looks like this cyclist was too. that wasn't the problem. crossing against the red in the dark looks to be the issue.
Sadly yes but so many cyclists think they're invincible.

And you and Rockslinger know that the driver of the van was drunk? Rockslinger knew it before the guy was even identified!

But to the point of drunk drivers killing people... I agree that it should be considered murder. In fact, I am of the opinion that drunk driving should be treated even more severely than it is.
not to forget that so far the driver hasn't been shown to have done anything wrong to cause the accident. the poor cyclist made a real bad mistake. if we're going to discuss drunk drivers, why not talk about farmers who rape pigs? it has just as much to do with this situation.

Plus, another 1,200 hit by cars but survived. Don't forget all the pedestrians and other motorists that have been killed as well and the number of houses destroyed or damaged by cars smashing into them.
At first I thought you were legitimately mad. But then I realized you just have a vendetta against drivers....

The carnage on our street continues. 42 year old male pedestrian killed after getting hit by two vehicles on Midland north of Finch. One vehicle stayed at the scene, the other vehicle drove off.

Just want to add that the cyclist killed had his light on. i saw it on a video on the news when they zoomed in.

Everyday is dangerous for pedestrians (and cyclists) but the next eight days is, statistically, the most dangerous so make sure you are wearing your helmet, reflective clothing, rear and front flashing lights before you leave the house. Also, please remember that drivers have problems seeing "small" people so make sure you are at least 6'3" and 300 lbs.
