In this case, I think it is more about the lady providing consent under duress and threat as she felt intimated with all those dudes in the room and whether the players should have known she was not freely consenting to this.

This seems to the Crowns burden to prove.

The girl that Mike Tyson got convicted on rape for and Kobe Bryant got charged for sexual assault with never said no, and never fought back either, they just submitted because they thought that was the easiest thing for them to do to get out of it, in those cases, one guy is 6 foot 10 and the other guy is the toughest guy in the world, in this hockey Canada trial there was 10 guys in the room five of them with their dicks out. I'm always curious why a person who drives drunk is completely responsible for their actions but a woman who has sex with a man isn't, while a man who has sex with a woman is.

It's misogynistic in its own way because it presumes a woman still isn't capable of making choices in her life, or being responsible for those choices.
Maybe it's because the women is seen to be at a disadvantage physically wise to the man and submits to the aggressiveness.

That premise assumes in all cases all men are rapists. It presumes guilt due to gender bias. It assumes in this case every man in that room would have gone along with physically harming her, by default.

It assumes a woman is incapable of consent under those circumstances, because it presumes , by default, she is always going to be intimidated at some point but not capable of expressing it. And that all men will automatically be presumed predisposed to raping her.

It presumes women, by default, should be considered unwilling participants in sex, before, during and after, no matter what. And that men are always presumed guilty, and must prove their innocence.

Like I said, I am amazed these Patriarchal notions that women are not capable of making and taking responsibility for bad decisions still exist.

That's what I suspected, these people ask for a lot of money, then hopefully they get a bit of it through settling out of court.

Like the Ken McElroy case, the widow filed a $5 million wrongful death lawsuit against the town, it was later settled out of court by all parties for $17,600. :ROFLMAO:
To get the big money in a civil case, it has to be a life altering experience like physical problems for life, you can never work again things like that. This girl was at work the next day.

The 3-way idea was all McLeod...if she had any knowledge about it the defence would have provided evidence...McLeod even lied to the Police about sending the 3-way message.
Fair enough.

Not sure if that alone is enough to get a conviction to the party of an offense charge though.

These five guys behaved one could say subjectively, deplorably and unwisely all things considered but not criminally and the same could be said about the lady.
The lady suffered from PCD( postcoital dysphoria) or PCT ( postcoital tristesse) as the consensual gang bang left a lingering bad taste, remorse and feelings of degradation with her, and perhaps with some of those guys the same condition.
I've seen this with my own eyes.

Lying on a bed masturbating is NOT consent…that is not an invitation for anybody to do anything…she can tease all she wants….and actually, she was lying on a bed sheet that was placed on the floor by the players and was asked to masturbate to put on a show.

She has NO responsibility to say NO…it is up to the players to ensure it is YES, that is legal consent

As far as your example goes, I’ve never heard a case where a guy gets drunk and says he was sexually assaulted that is a ridiculous example
