That was in civil court, specifically on the question of rape as defined in New York in the 1990s.
In other words, "was a penis inserted into a vagina".
They said they couldn't be sure enough to vote yes on that issue.

But you asked why there wasn't a criminal charge.
The statute of limitations for criminal rape in New York in the 90s was 5 years.
That's your answer.
(Would there have been a charge if there was no statute of limitations? We will never know.)
