It could just as easily have been a left wing parent who issued a bomb threat, to Oakville Trafalgar High School. Why are the right wingers getting all the blame??

Right wing is much more violent right now and being actively encouraged to be that way.

Also, from the brief descriptions we have had of the bomb threats, they are threatening the school for employing this person and or for not doing what the people who are angry about it want.

If the threats were attacking the school for not supporting the teacher enough, or were threats against the parents for protesting, it would have been trumpeted from the rooftops, I expect.

Well, that's exactly how it would play out in a hearing, so the decision maker will have to make the same decision. Not that complicated. You ask for a medical opinion as to whether the individual is behaving according to their bona fide belief that they are transexual and, further, whether the wearing of the particular prosthetic is recommended by the doctor for the benefit of the individual's mental health. You also ask the doctor if Lemieux's mental health poses any limitation on his ability to function as a teacher or whether it poses any risks to students. If Lemieux can overcome those hurdles (which I doubt), you then move on to whether the Board can reasonably accomodate this individual's mental health needs.
With all due respect- not that complicated?? At the crazy time when we can't define what is a woman? Good luck with that.

Because they took their attorneys' advice?
We don't even know who their lawyers are?? I trust Howard Levitt's opinion more than their lawyers' opinion!! Also, why do the taxpayers have to pay for these consultants??

Okay. But you're not a school board member. So you don't get to choose what lawyers they hire and listen to, do you?

And if they hire a lawyer you don't like and listen to his / her advice, that still doesn't make them incompetent, does it?

They are just running the clock until the end of the semester and politely telling the trustees and the provincial government to go fuck themselves.

I understand why people are angry but at the end of the day it’s the school board’s decision.

Mitchell: Suppose that a lawyer told you that if the school board tries to fire Kayla Lemieux they will almost certainly find themselves on the wrong end of a civil suit and have to pay damages that will financially cripple the board’s funding for next school year. Would you say, “I don’t care. Pay the money if that’s what it takes to get rid of her”? Or would you just let her ride out the semester at home on medical leave?

KB, I guess you're right. However, In this case I think the board might have a good chance in court. Obviously, I'm not a lawyer. However, IMHO if you're involved in a civil lawsuit, then both sets of lawyers get to do discoveries. In these discoveries, it will come out that Lemieux is lying. The Defence lawyers will get doctors to check Lemieux out etc ie Get one of their Doctors to give Lemieux a physical exam. Then the Doc will discover that her boobs are fake---LOL

Also, what's stopping Lemieux from getting paid home leave for years, and just not this semester??

I don’t know. It’s possible that she could be on long term medical leave for years. Maybe that’s how this will end up? At that point it would be the board’s insurance company that would be paying her disability benefits.

PS: I think eventually the board will implement a new dress code policy that will address the concerns about Lemieux and at that point if she doesn’t comply they could fire her. Apparently, though, they can’t make a policy change like that while they are in the middle of collective bargaining with the teachers union. It will thus take awhile but I think it will get done eventually.

Given the current climate and judging by a lot of the responses on this board, that may be easier said than done.
Members on your side of the table have been characterizing efforts to get rid of this guy as anti Trans.
Would that not be the argument in court, how do you then implement and enforce compliance if the dress code is deemed to be anti Trans.
How do you get over that hump?

I dunno…was there not a suggestion out there that as long as the nipples were not visibly poking through the shirt then the rest was okay?

In my opinion, it’s not even just the boobs…her entire presentation is clownishly ridiculous. The dress code would have to specifically describe appropriate professional attire…but I have no idea how they can regulate the size of boobs (real or fake) other than insisting that clothing not be too tight or revealing and that staff are clean, well kempt, and present an appropriate professional image?

It’s a difficult question.
