I posted a thread in the Bill C-36 forum in light of Alito arguing that to continue Roe and Griswold as doctrine means the court will have to recognize sex work and illicit drug use as legally protected rights(shades of Insite and Bedford in Canada). By making this radical political shift to the right it would seem that SCOTUS is going to force the SCC to shift even harder in the other direction towards social liberalism. Perhaps Alan Young will get his wish of seeing the SCC throw out Malmo Levine from the late 90s and go all in making two party consensual conduct(sex work, drugs, obscenity) a constitutionally protected right in Canada.


There is some suggestion on the Canadian front that Trudeau should make abortion constitutionally protected with specific Charter language. I don't think that is in the cards as you need at least 7 provinces and Alberta and/or Ontario probably need to be one of the 7 to get over the hurdle to amend. In fact every province right now other than BC, Newfoundland, and Quebec has conservative govt. Trudeau obviously can and most in Ottawa are already predicting he will use this as a sledgehammer against the Tories(and even Trudeau critics on Twitter are saying rightfully so. In fact I suspect BC might be the only province that would approve a successful Charter amendment at this point.

Democracy (American version) works.

PS: It is the reason the conservatives in USA are willing to hold their noses and overlook all of Trump's character flaws.

Trudeau doesn't have to do that. There is no movement in Canada to overturn Morgentaler. And unlike the US, criminal law is a federal head of jurisdiction in Canada. This is a non issue in Canada.

I believe consensual sex is already a Charter protected issue in Canada, except incest, child sex and bestiality. You want to fuck 8 transexuals in leather jumpsuits in the back room of a club. Go ahead. Just make sure no kids are there. Hopefully sex work will be added in the near future.

I don't think the SCC gives a half-shit what the Americans do or reacts to it. Why would they?

You are correct that consensual sex is already protected under the Labaye swingers club case although the Ontario Court of Appeals didn't seem to want to bring this up on procedural grounds during the last C-36 case a few months back.

Sure. There are a couple dozen prairie Tory right wing backbenchers who went to too much Sunday school as small town kids. Demographics is not on their side. And unlike the USA, Canada doesn't gerrymander.Canada is far more urban and far less Jesus than the US.

Comparing the Ontario Court of Appeals and the US Supreme Court is a bit apples and oranges but I will say this leaked opinion is pure judicial radicalism compared to the OCA's desperate politically motivated to desire in my opinion to avoid dealing with the fundamental issues with Bill C-36 on procedural grounds. If you haven't noticed I am still kind of pissed off at the Ontario Court of Appeals and Doug Ford's Justice Ministry.

It certainly destroys the little game wherein Abbot, De Santis and the rest of the slithering scum can enact repressive laws, smug in the presumption that the USSC will strike them down or limit them in a more gradual chipping away attack on Roe. If such is the case, no one is really going to give too much of a shit. Everyone presumes the law dies in its tracks in a few months.

Now all bets are off. The Jesus-fascists will demand similar laws abolishing same sex marriage and recriminalizing homosexuality. And the backlash to all of these laws from what Ottawa cuck calls the "leftie freaks" - but which are actually going to be about 90% of all educated urban white collar workers and professionals - is going to be immense, sustained and angry to the point of violence. Cue in counter violence from the right and we are going to have shit that's going to look like the IRA Troubles in Ulster for the next couple of decades.
