Or are you just claiming false advertising because you were disappointed you didn't actually get to see some crap coming out of a sweet young girls asshole?

I take it you grew up in very tame environment where nobody loses their temper, but I can tell you that people say crazy things when they're pumped up and angry - things they don't actually intend.
well sorry to burst your bubble but an environment where people constantly lose their temper and say/do crazy things when they're angry and pumped is not a good environment. Its a sign of emotional instability. Anyone in their right mind would be able to control themselves. Its a dangerous situation when the person concerned is a judge. The dude clearly loses it and lets his emotions take over. That is something you can't do as a judge. Can you imagine having him as your judge when he's having a bad day or clearly can't be rational? Any parent in their right mind would be able to understand that there is nothing wrong with downloading a computer game. Its not like downloading porn or so, in that it could lead to developmental problems for the kid later on. Infact video games simulate a kids mind and even their reflexes. Ever wonder why all the nerds are usually gamers?

did you get punished like that all the time?
From what I can remember, I was tied up, strapped with a skipping rope and sometimes with the vaccum cleaner, locked in the closet/storage room, kicked out of the house sometimes in the winter with no coat. All this between the ages of 6 to 12.
If you guys think I'm making this shit up, then you really don't know anything.

Again, I'm not even saying what the judge did was right either. But I'm just not at all surprised that these things happen either.

Oh, should probably say that I don't have a good relationship with my parents either till this day.

I believe you. But it's abuse. And it's wrong.

Why? She played it up for the undercover cam.
Wow, you would have made a great judge yourself. Obviously she was throwing herself at the belt. I'll bet off camera she grabbed the belt and whacked herself while he tried to wrestle it from her. The beating I saw when he whipped her across the arms and stomach while she was trying to protect herself was probably glare off the lights and the loud fleshy cracks of sound as the blows rained on her body was a clicker hidden in her palm. If the judge is a republican you would make a great FOX news reporter.

I'll wager this judge sat in the front pew of the church and sang songs of forgiveness.

BTW: The wife is a sick bitch herself. Not only did she get in on the action after the girl was already beaten by judge - she did nothing to calm the situation - in fact- she seemed to encourage the punishment.

I've said pretty much the same thing you have. I've already said that he may not be fit to be a parent nor a judge based on his temperament. You have no argument with me.

I quoted fuji's comment where he says I shouldn't have kids or be around kids even temporarily. It was to show that I've been around kids and was a model babysitter rather than a menace. The irony of it all, is that the kid I was babysitting was an actual menace.

GG@, hitting a teenager with a belt is assault with a weapon in this jurisdiction. So we have a judge - who is clearly a major league wack job - committing a felony on his own helpless daughter. And clearly emotionally out of control while he does so. I have clients who get a couple of months in jail for doing exactly what this guy did.

If the judge's conduct was legally in any way in a "grey area", you might begin to have the pathetic beginnings of an argument. But it wasn't. And you don't.

Now stop annoying Fuji.
A lawyer on CNN said something that if this wasn't a felony offence (no lasting injury, corporal punishment only), it would be statute-barred, and he pointed out other grey areas. That doesn't mean that what the judge did was not wrong.

However, if the 'child' (how old was she?) is disabled, how could she be capable of defending herself?

I know that in Ontario, the statute of limitations doesn't apply to child abuse cases. Perhaps there's some similar exemption in Texas.

Texas does have a "right to discipline your child law," however, that law does not give you the right to cross the line into child abuse.

As the Texas Attorney General's Office says in their guidelines: Punishment is abusive if it causes injury. When you beat a child with a belt where it leaves welts across that child's body for days or weeks, you've crossed the line.

We can argue about a wack or two or three with a belt, but 17!

No there is not the statute has run.

Besides being statute-barred, wouldn't she have to have taken a pic of herself to prove any injury you describe? (This is another reason why that CNN lawyer felt it's not a slam dunk for a conviction).

Needless to say there would have to be evidence which could be produced at trial.

Who said an assault must result in physical harm in order for their to be a crime ?

The practical reality is that in this sort of case in a jurisdiction with a "right to discipline law" you need to be able even as the Texas Attorney General's Office stated (see #105) to so prove or else you are never going to obtain a conviction.

aardy, the belt, the repeated blows and the guy's ranting are enough to convict.
