I'm any case, you might want to look up "fair comment" under US law. Also, as the statements weren't made in any US state, so I could only be charged with federal criminal libel, which this clearly isn't.
Plus I think it's fair to say that when we talk about no one being "above the law", generally we mean criminal acts, called felonies in the states, and slander/libel, with the exception of criminal libel which this isn't, is civil law. Afterall, the Democrats can't control whether private citizens bring civil cases against someone or not, so it would be weird to call those "political".
But hey, if it makes you feel better, don't address the point that maybe the prosecutor thinks people who break the law should be held accountable rather than worrying about the political ramifications. Because it seems to me that right from the start of all this plenty of people were saying this would help Trump and hurt the Democrats.
