Traffic Court trial: Driving with no/expired driver's licence

Just would like some input.

In 2 weeks I have a traffic court date for driving with no/expired driver's licence.

When I attend the trial, how should I plea? (guilty with an explanation, not guilty with an explanation or plea bargain with the crown?)

The fine is $325 dollars plus whatever insurance rate hike I may receive from my car insurance company should I get convicted?

What can I do to minimize or eliminate this annoying traffic ticket charge?

Were your driving without a license? or was it expired? ...If Yes, Then I am fucking glad you got caught and pay the fine you fuckwad!

It is people like you that causes others to pay more for insurance in the first place! and/or you are also more likely (Statistically) to also not maintain insurance...who gave you the right to ignore the rules that others must follow?

Did you fix the problem immediately? Was it just an oversight and not intentional? Was it due to poverty?
If so, perhaps guilty with an explanation.

Just to clarify, I forgot to renew my driver's licence.
Too many things were cluttering my mind and I was nabbed 2 months after my birthday month for not having a driver's licence.

Now, I've been driving for over 20 years so I don't believe that having an expired driver's licence is going to make me a bad driver.

For an administrative process, this type of traffic ticket should not be going to court but a regular payable fine like $150 dollars is good change for the MTO to easily collect rather than clogging up the traffic court system with administrative charges.

Constructive input is most appreciative and anybody who has been through the process please feel free to give some advice.

No mention of driving without insurance, can't see why his failure to get a new license caused me any problem either.

My driver's licence had expired. As for throwing anybody under the bus who does not follow everything perfectly in life, I bet that you never had a driving infraction in your perfect driver's record? Bravo to your perfect life!!

Why don't you take it further with your comments "It is people like you....", <---- feel free to insert all ethnic races, creed, sex, etc so that we truly know how you feel about people??

Sadly, I believe that if you're a parent, I feel sorry for your children. If you work with people.......enuff said.

Plead guilty to a lesser offence. Talk to the prosecutor on the day of. S/he will tell you exactly which offence to plead guilty to. Good luck!

* P.S. I had full insurance, licence plate renewal sticker etc. I was a bit confused thinking why would they send me the same request for renewing my licence plate sticker when in fact it was for the renewal of my driver's licence. Me thinks they should bundle everything up (driver's licence and licence plate renewal).

Sorry to hear about your bad luck. In the big scheme of things a two months past expired license seems like a fairly small infraction as opposed to having your license revoked and then driving. Maybe you can haggle for a reduced charge not sure what it might be, maybe not being able to produce required document. Seems to me driving with no license as opposed to two months expired would deserve a lower fine.

If you want to plead to a lessor, it has to be a "lesser included." WIthout taking my HTA off the shelf I think you might be able to plead to "drive with improper license".

So here is how it works. If this is your first date, it is only a "set date" court where they will find out if you want to plead and if not give you a trial date. Depending on how busy they are they might be willing to take your plea that day...if it is "guilty." If not you have to come back again on the trial date.

If you just want to get this over with, talk to the prosecutor very nicely on the first day and work out a plea deal. You can probably convince them to agree to a fine of about $200.

If you want a trial and your day in court, that is a much longer explanation.

Why can't you just accept a little personal responsibility for your mistake instead of wasting the court's time? You made an error, accept it, pay the fine and move on.

Yes, I will take full responsibility. Did I say anything in my posts that I want to completely get out of it? No, I did also mention that I want to minimize the traffic ticket charge or eliminate it if possible.

Just don't 'convict' everyone who has been charged.
There are real honest mistakes and blatant ones. Unfortunately, our traffic court systems cannot differentiate between the two.

Thanks for your 'tough love' advice.
I'm sure if the same happens to you, you would want options rather than punish yourself more harshly than what the courts would be inclined to do.

Good judgment - if only you were a judge and hanging was an option ! He forgot to renew, yeah that's the same as driving without a license because it was suspended for drinking and/or vehicular manslaughter.

They must support a fine otherwise no one would renew but I can't see why it would affect your insurance rates with the exception of the speeding ticket they gave you when it was discovered the license was expired.

If you want to try to weasel out of it or delay it so as not to affect an upcoming insurance renewal you can elect to proceed if the police officer is not present, and if he is then ask for a continuance so that you can get a lawyer Then next time the cop might not show up.

Did you get a summons or a ticket? If it is summons, then it will be a first appearance to set a trial date.. I think they will be willing to drop the charge to unable to produce drivers lic. or something minor which is $150. How long out of date was it?
