Fact Check: Was Journalist Arrested in Ohio for Covering Train Derailment?

Newsweek covered the initial reports about how NewsNation reporter Evan Lambert was arrested at a press conference on Wednesday February 8 regarding the derailment in Ohio on Wednesday.

Footage of Lambert's arrest went viral on social media, with one tweet by NewsNation attracting more than 7.9 million views. Further video released by the Ohio State Highway Patrol showed Lambert involved in an argument before he was taken out of the East Palestine school gymnasium where the conference was being held. He was then taken to the ground and moved out of the building.

County Municipal Court records show Lambert was arrested on two counts, resisting arrest and criminal trespass, and later released on bond.

The claim that he was arrested for reporting the truth, viewed on its own, is misleading. While Lambert was removed from the venue and arrested, the clip shared by Greene, viewed alone, does not provide all the facts.

As noted by NewsNation, Lambert was in a room "full of other journalists doing their job" so there is little likelihood that police or officials were trying to prevent "the truth" from being reported.

Regardless of one's views of the incident, the footage shared by Greene editorializes the facts. Fitted in among other claims about underreporting of the Ohio derailment story, it may create the impression of a more conspiratorial plot.

NewsNation has defended its reporter, with its Washington bureau chief Mike Viqueira telling the channel's On Balance host Leland Vittert on Wednesday that Lambert behaved professionally while being "manhandled." He added that Lambert was talking very quietly to the camera and reporting on a "very critical story" of interest to the public.

Ohio Governor Mike DeWine, who had been speaking to reporters, said that Lambert's arrest was nothing he authorized and added that he's fine with people doing a live broadcast while he's talking during a press conference. "I'm certainly very, very sorry that that happened," he said.

"I don't know all the facts but he or she—whoever was arrested—had every right to be reporting and do what they do every single day."

Newsweek has contacted Ohio State Highway Patrol, NewsNation and Marjorie Taylor Greene for comment.

As acknowledged by NewsNation, there were many other journalists at the same press conference where Lambert was arrested, so the notion that a reporter was arrested for "reporting the truth" (as the clip posted by Taylor Greene states) does not accurately reflect all of the circumstances surrounding the incident.

Listen, this disaster has been reported by all the various news media, and even in Canada itself. So nothing of a conspiracy in that respect. However this outrageous Conspiracy Theorist statement by MTG is crystal clear how either dumb or she is trying to stir up the usual far right base:

The fact is that the crew had to release these toxic gases as it was due to the risk of an explosion, that would have been catastrophic. The manner in which these cars were crushed and the pressure if not released could then have caused an explosion. As usual MTG is full of BS!!

By the way that reporter was arrested for trespassing. He was warned on several occasions to leave!!

By the way, in the past residents had demanded far better environmental protection by railways in transporting such chemicals. But as usual the Trump administration has always done his best to deregulate such health hazard regulations. Are you going to point a finger in his direction?

The Trump administration, under pressure from lobbyists who argued the change was costly to rail companies, rescinded the rule.

The derailment of a 150-car train carrying hazardous material in East Palestine, Ohio, was likely more severe because the Trump administration repealed a key safety rule, according to an industry insider.

On February 3, the Norfolk Southern Railway freight train derailed at approximately 8:55 p.m. local time before catching fire near the state border with Pennsylvania.

While there were no injuries, the train included a number of cars containing vinyl chloride, a potentially explosive colorless gas, resulting in about 5,000 people being evacuated on the orders of the Ohio and Pennsylvania governors.

Rescue workers blew holes in five railway carts on February 6, allowing them to conduct a controlled burn of vinyl chloride, which released toxic chemicals into the air.

Speaking to investigative news outlet The Lever, Steven Ditmeyer, a former top official at the Federal Railroad Administration (FRA), said the "severity" of the accident was likely increased by the lack of Electronically Controlled Pneumatic (ECP) brakes.

A rule was passed under President Barack Obama that made it a requirement for trains carrying hazardous flammable materials to have ECP brakes, but this was rescinded in 2017 by the Trump administration.

The industry said it would cost more than $3 billion to implement. The FRA under Obama said it would be around half a billion.

The National Transportation Safety Board, a federal agency responsible for investigating rail accidents, told The Lever that the Ohio train that derailed was not fitted with ECP brakes.

"Would ECP brakes have reduced the severity of this accident? Yes," Ditmeyer said.

Referring to opposition from within the rail industry to fitting ECP brakes, he added: "The railroads will test new features. But once they are told they have to do it ... they don't want to spend the money."

Nor have rail regulators in Transportation Secretary Pete Buttigieg's department proposed reinstating the safety rule in question, The Lever reported. A spokesperson for the FRA told the outlet that it was continuing to evaluate ECP brakes to improve safety.

Newsweek reached out to Donald Trump, the Norfolk Southern Railway and the White House for comment.
