As it's mentioned in the department of justice website, the courts will decide case by case. Did you know that law isn't an exact science ?
Yes, though it would be nice if the law was clear & detailed enough so those under the law knew their boundaries, or what they were allowed and not allowed to do.

The article which you kindly provided says:

"Sexual activity in the context of ongoing relationships also fails to meet the test, unless the evidence shows that the alleged consideration was contingent on the provision of a particular sexual service.Footnote 28 In one case, gifts given to the complainant were not viewed as consideration for sexual favours rendered, but rather as gifts given “dans le cadre plus large de la relation affective entre l’accusé et le plaignant”.Footnote 29 Another case held that the phrase “sexual services for consideration” is not intended to apply to consensual actions between those having an affinity towards one another.Footnote 30

"The following activities have been found to constitute a sexual service or an act of prostitution, if provided in return for some form of consideration: lap-dancing, which involves sitting in the client’s lap and simulating sexual intercourse;Footnote 31 masturbation of a client in the context of a massage parlour, whether or not the client climaxes;Footnote 32 and, sado-masochistic activities, provided that the acts can be considered to be sexually stimulating/gratifying.Footnote 33 However, jurisprudence is clear that neither acts related to the production of pornography,Footnote 34 nor strippingFootnote 35 meet the test. In most cases, physical contact, or sexual interaction, between the person providing the service and the person receiving it is required; however, acts for which consideration is provided that take place in a private room in a club and that are sexual in nature, but do not involve physical contact between the “client” and “performer”, such as self-masturbation, have been found to constitute prostitution.Footnote 36"

Can anyone translate the French portion into English?

So if you mutually have "an affinity" with your SP, you might be off the hook for paying for sex, eh? Like a mistress or sugar baby, perhaps? I'd like to read about that case (footnote 30), if anyone could help direct me to it.

2. What’s a “sexual service”?

The bill doesn’t say, meaning it would likely be up to a court to decide where the line was drawn. A government legal brief, submitted to the committee as it considered the bill, says the courts have found lap-dancing and masturbation in a massage parlour‎ count as a "sexual service" or prostitution, but not stripping or the production of pornography.

"Sex workers work in a range of physical and virtual spaces/places and may involve either
‘direct’ and/or ‘indirect’ sexual services (Harcourt and Donovan, 2005) and include: (i)
telephone sex lines; (ii) street-based sex work; (iii) private sex work (operate from home);
(iii) brothel/sauna/massage parlour-based sex work; (iv) escorting; (v)
burlesque/stripping/lap-dancing; (vi) BDSM/fetish clubs; (vii) swingers clubs; (viii) webcamming;
and (ix) amateur and professional porn production.

"Hence, whilst sex (masturbation, oral, vaginal and/or anal) is obviously a common element
of street, brothel and escort-based sex work companionship and other forms of nonpenetrative
intimacy (e.g. cuddling, touching, stroking, massage, kissing and conversation)
may also be an intricate part of the bundle of services offered by sex workers. Sex work
then can be both transactional and ‘therapeutic’.

"A key message from this wealth of research is the multi-dimensionality of sex work and as
described in the title, it is more than just sex and more than just work."

This sounds familiar:

How does payment happen?

Payment happens during your cuddling appointment. Always prepare the money in an envelope for the exchange. Conduct the exchange upon the first minutes of meeting as no one likes to feel uncertain about payment, this will ensure a more comfortable cuddling session

Same C-36 argument here as in a MP where everything is paid upfront

In MP you paid for time and massage. Whatever spontaneously happens between 2 adults in private is not the laws concern.

Same with cuddling. You have paid to be cuddled. Now as long as you gave her no additional $$$ for sex, if sex does happen no one has broken C-36 ? because you never paid her for sex - it was spontaneously done between two consenting adults

It seems to me the only way you could be charged is if she is a cop and asks for extra money for a HJ etc and you agree

In the old law this was legal because it was done in private but under C-36 it is illegal even in private

Sex is illegal in Canada. Does that include hugs, cuddles & kisses? Nude or non nude?

I've had my dentist & doctor pressing their big tits on my head & chest. Does that count?

I think a Vice cop would be humiliated having to bust someone for cuddling.

LE would call it "exploitation and trafficking" ;

Got to get their quotas.

If i were a cop i'd be embarrassed to arrest people for making love.

I've had my dentist pulling out a tooth put me in a headlock with my head against her breast . Guess it compensated for the pain a bit.

Cuddle up works by offering 10 "free" contacts then they charge $$$$$$$$$

Makes me wonder about the validity of the cuddlers, they could be scams just so you sign up

Personally, I think the idea is legit. Although not for everyone, I can see its value

Could be great for those with qynephobia ( an abnormal fear of women) and could be extension of psychotherapy and gays coming out cuddling with same sex

Question allowing strangers into your house to cuddle so perhaps an extension of RMT service or even MPA, nothing sexual just cuddle

Set up street office where it would be safe

I could see a cuddle booth at the Sex shows or even the Ex

Cuddle at SC with a stripper ?

The Canadian government Department of Justice site here does not mention kissing or cuddling as a sexual service:

"Q4. The new purchasing offence prohibits “obtaining sexual services for consideration”. What is a “sexual service” and what does “obtaining a sexual service for consideration” mean?

"A4. A “sexual service” is a service that is sexual in nature and whose purpose is to sexually gratify the person who receives it. “Obtaining a sexual service for consideration” involves an agreement for a specific sexual service in return for payment or another kind of consideration, including drugs or alcohol. It doesn’t matter whether payment is made by the person who receives the sexual service or by another person.

"Activities that amount to “obtaining a sexual service for consideration”, if a person pays for them, include: sexual intercourse; masturbation; oral sex; lap-dancing, which involves sitting in a person’s lap and simulating sexual intercourse; and, sado-masochistic activities, provided that the acts can be considered to be sexually stimulating or gratifying."

Interesting that S&M is not illegal providing it is not sexual in nature and S&M is often not sexual in nature, contrary to popular belief.

I would think cuddling, while it could easily create erection, is not sexual in nature and erections are incidental like they are with a RMT.

Cuddling could easily be used as a C-36 dodge as once there you are in private what happens is spontaneous between 2 consenting adults.

No doubt some of the cuddlers on the site are providing sex but a cuddling sting seems unlikely.

Cops would have to have a undercover cop as the cuddler who negotiates after you arrive. To be safe never discuss sex before hand so if you are looking for sex you very well may end up cuddling instead

The Canadian government Department of Justice website just listed examples and not complete list of activities that are sexually gratifying. Kissing and cuddling can be added to the list if they are considered as sexually gratifying.
The portion quoted does not say the list are "just...examples" or deny that.

Neither does it say the list is either complete or "not complete".

Neither does it define the terms used.
