US Judge blocks Trump's birthright citizenship order, calls it 'blatantly unconstitutional'

A federal judge in Seattle on Thursday blocked President Donald Trump's administration from implementing an executive order curtailing the right to automatic birthright citizenship in the United States, calling it "blatantly unconstitutional."

U.S. District Judge John Coughenour at the urging of four Democratic-led states issued a temporary restraining order preventing the administration from enforcing the order, which the Republican president signed on Monday during his first day in office.

"This is blatantly unconstitutional order," the judge told a lawyer with the U.S. Justice Department defending Trump's order.

The order has prompted five lawsuits from civil rights organizations and Democratic attorneys general representing 22 states, who describe it as a blatant breach of the U.S. Constitution.

And now we see how the other four lawsuits play out.

This is a 2-week halt, which doesn't really matter since the order was set to start sometime in February anyway.

I'm glad this judge came out strongly against it, but we are going to have to see if that is the consistent lower court response or not and even that is only the beginning of the issue.

A step in the right direction I believe.
But lets see how it plays out.

The dems found a loophole that they can let migrants from the south in and let them take advantage of birthright citizenship. The loophole needs to be closed. It would be cool if Trump could pull this off.

Not sure if I agree with h1b getting also but by this as highly intelligent and qualified people would get discouraged. We need the best of the best to come to America and starting good stable families here.

He could possibly pull this off as he has both the house and the senate.
Ending it via legal ways on its own is not so alarming as many countries in the past have done so.
But his undermining of a constitutional right via an executive order is.
There used to be a time when EOs were looked down upon.
But of course MAGA ideology and Project 2025 calls for greatly increasing the powers of the presidency and undermining the constitution whenever it suits them.

No.
The whole argument is to try and redefine what is already in the amendment.

That way you avoid the Constitutional amendment part, which is very hard to do in the US.

Even passing laws is difficult in the US, thanks to the filibuster and many other veto points.

But this way, you only need the Supreme Court to agree with you.

Indeed.
Doing this by way of EO would actually help demonstrate the new order of things.

Almost impossible this gets passed but they’ve had 4 years to develop a plan on this. Let’s see what Trumps people have up their sleeve. I bet there is a secondary result they are aiming for.
