There will be several eminently well qualified Black, female judges who are able to do this task as well as any white male can. Affirmative action for Bench appointments is pretty standard anywhere.
Affirmative action for the skilled positions is wrong and often downright dangerous. We saw that when Obama appointed the "wise Latina" who completely embarrassed herself in the mandates case just a couple of weeks ago when she couldn't even grasp simplest data. By announcing the race as being the most important qualification, Biden is telling America that judicial excellence is a secondary consideration for the one of the most important position in the Republic. Good luck selling the expansion of the Court after this kind of decision.

It's funny, but if Avenatti is going to run for the President as the CNN suggested, he must show his willingness to be an equal opportunity sleazoid lawyer.

I thought he was convicted last year for fraud or something....so unfortunately he will not be a part of the theatre in 2024

What I said, JC. There are likely to be any number of talented Black, female jurists in the US. Being a judge is more about insight and judgment than technical skill.

And what about the GOP appointees?..... Kavanaugh is basically the judicial house-pet of the GOP and has dick-all independence of thought. Amy Coney-Barrett is an extremist Catholic and was picked for her anti abortion views. Are you telling me that THOSE people are the "best and brightest"?!

It's funny how the right only call for fairness when they are the ones who might not benefit on something. So, are you going to claim that who ever Biden appoints is going to be unqualified? Is it because they are a woman or because they are black? I mean, the argument can definitely be made that there were significantly better qualified judges that could have been appointed instead of Kavanaugh or ACB.

What a silly analysis. If you want to look at appointments by percentage, you'd have to look at what percentage of the bar was black at various points in time, what percentage were senior and well-respected counsel, what percentage were appointed to lower courts, what percentage of lower court judges who were black were thereafter appointed to a higher court, etc. etc.

There's no point looking for SCOTUS appointments to be 14% black until at least 14% of the bar is black, 14% of the most respected members of the bar are black, and on and on up the recruitment chain, etc. etc. It's going to take generations for that to happen.

By the the time it does, hopefully the legal profession might get their minds around the concept of merit, and all of this won't matter anyway.

How many exceptional black lawyers and judges were overlooked for a seat on this court because of the colour of their skin. Or because they were female. Basically it's been exclusively for WASP judges. It's not that they didn't choose POC, they just downright ignored them. Thurgood Marshall is an outlier.

And I will agree with you, looking at the percentages of minorities in the ranks of justices is silly. But so is the whole argument that appointing a black female judge means she isn't without merit. We don't know who she is, but it will likely be someone with a long history of exceptional service. And when it is announced, I'd be interested to see how she stacks up to ACB or Kavanugh. I mean, did you get uppity over Kavanaugh, a mediocre judge at best?

Anyone who will be appointed, brilliant may she be, will always be diminished by the race and gender prerequisites. There's no other way to look at it- just ask Kamala. I guess the dream of MLK is truly and finally dead... among the Democrats. Which makes perfect sense.

The SCOTUS should reflect the diversity of the life experiences of the people affected by their rulings. To suggest that any point in time any Justice nominated is the very best in the country is absurd. Their are always political considerations. The fact is that all of the appointees of the now former only twice impeached POTUS in history were selected by the Federalist Society. It is also a fact that Amy Coney Barret was chosen because she was a woman. Whoever Joe picks will be highly qualified and you will see a rating or recommendation of the ABA and other legal groups unlike the previous 4 years.
