I was taught that opinions are supposed to be backed up by facts.

Putting your hands over your ears and yelling “Lalalalalalala...I can’t hear you” as loud as you can doesn’t actually count as an opinion.

I thought you were some sorta lawyer...Don’t they teach you shit like that in Law School?

Trump is now suing for $20 million, admitting there is a NDA and claiming that Daniels broke it 20 times.
He's also put his name on the suit, admitting that he knew about the payment.

That would make the hush money an illegal payment, wouldn't it?

No doubt the adjudicating Judge in California will throw out this ridiculous $20 million lawsuit against Stormy Daniels.

It's not a federal case. He is asking to have it transferred to the state courts in NY state.

Mr. Trump formally joined his legal team’s response to Ms. Clifford’s suit in a motion, filed Friday, to move the case from state court in Los Angeles, where Ms. Clifford filed her claim, to federal court.

Mr. Trump’s reason for asking that the case be moved probably concerns the Federal Arbitration Act, which makes arbitration the preferred forum for resolving many kinds of disputes. Federal courts have applied that law more strictly than state courts, particularly ones in California. Mr. Trump may be hoping that his chances of keeping the dispute in arbitration and out of public view are better before a federal judge than a state one.

I believe that procedural once he commenced the action claiming $20M it gets automatically transferred to federal Court. Trump is trying to get it transferred to arbitration which is private. The issue is which court will be more likely to agree that it belongs in arbitration and the calculus must have been made that its is federal where he has appointed more judges.

The judges are presumed to be impartial so the fact that trump appointed them should have no bearing.

That has always been my understanding. If the contract is invalid, then the arbitration clause is invalid also.

Trump admits he paid Daniels $130,000 and she should shut up even after his lawyer admitted he made the payment?
Not sure that is true, but he can still sue to enforce it.

If she is alleging there was a criminal act related to the material covered by the NDA, then she can go to a U.S. Attorney's Office or if she is alleging a state crime a District Attorney's Office, which can then seek a court order, that, however, doesn't allow her to go talk to the press.
