Huge difference. No condom puts the woman at risk for disease and pregnancy.
I also believe that a trans woman is a woman under the law so there is no legal issue.
It seems like it would be no different than misrepresenting yourself before a sexual experience. Should there be legal consequences for embellishing your size or the quality of sex she’s going to have, if she gives you the chance? I’m not into implants; should we make a law so that women have to disclose that her breasts are fake if I ask?
It’s not fraud unless money was exchanged. Doubt you’d go to the cops if you feel she committed fraud by having sex with you for money under the false pretences of what she disclosed as her birth sex.
If you found out “after” you had sex, do you mean she’s post-op / transsexual? Not sure why anyone would make a law about this.
Otherwise, you would have somehow had sex with her without noticing she had a penis and testicals. That seems like it’d be on you. I’m also not sure why someone would make a law about this. If they did, who would come forward? Have fun with the police interview: “I thought she was only into bum sex, and foreplay is a waste of my time. She should go to jail for making me gay.”
Feels like these would be laws only for a heinously transphobic society...

Maybe if this happened in Iran or some other fucked up theocracy, it might be a problem... but here... I’m just not sure what the problem is. You could have charged her for sodomy at one point, but you’d probably be charged as well. Protection of the ability to tell your homies with honesty that “I’ve never fucked a man” doesn’t seem like something we’d need to write into our criminal code.
I don’t see how this connects to the stealthing issue, which very obviously causes harm.

I have a trans family member who I wouldn’t know was trans today had I not known her by a different name before she hit puberty.
A good friend is trans. If I’m visiting her, we’ll hit a trans bar every once in awhile. I’m always reminded that a big number of transpeople hide in plain site.

If HRT is more widely used when kids self-identify early, I think you’ll see a shift away from being able to “tell” as easily as we can today, without examining her while she’s undressed.
Yes, there should be legal consequences! Is assault pure and simple. It all about consent! Would you give consent to have sex if you know the person has HIV or AIDS. I would not give consent if the person is "TRANSGENDER ".

OK, how about this: sex between two consenting 15 year old teens is legal. But what if a biological 47 year old women identify herself as 15 year old girl? Is she allowed to have sex with 15 year old boys? Or even worse: What if 15 year old girl identifies herself as 20 year old women. Does she need to tell me her "biological" age instead of her "self-identified" age before I consent to sex with her?
