They said at the news conference that it was a Ruger - maybe a Bush Master shooting .223 or Nato rounds. If that picture is his rifle then it's a red-dot sight - maybe 3 MOA meaning the red dot would cover a grouping of about 3 inches at 100 yards. No bump stock on the rifle in the picture. It's a semi-auto.M-4 assault carbine with all the bells and whistles. Someone who knows more about modern military firearms can tell me if he has a telescopic site and a red lazer-dot siting aid?

That should disqualify him from ownership under US law.If it's true that Devin Kelly was dishonourably discharged from the Air Force then he could not legally be in possession of a firearm. So if he had tried to purchase a weapon at a dealer, the mandatory background check would reveal that he can't buy a firearm. BUT, the gun show loophole would make it very easy for him to simply go to a show, and walk out with any number of weapons. I would bet that he acquired his weapons at a gun show, free from a background check, and once he had his rifles, nobody would ever check him out because you don't require a permit or license in Texas. The U.S. should ban secondary market gun sales except through a licensed gun dealer (therefore requiring background checks for every sale). Closing this loophole wouldn't totally eliminate the problem (since they could still acquire weapons illegally) but would at least make it harder than just going to the weekly gun show. Closing this loophole would have no effect on 2nd Amendment rights. It's a loophole that should never have existed.
