M'thinks it was not fuji letting the facts fall by the wayside...

Perry
Or not.

That the woman had a history of depressive illness once again goes to egg shell.

However, if I were with the CPS, frankly, sad as this suicide was, it wouldn't be my principle focus, rather the attempt to obtain information - please don't argue that the DJs didn't intend to be put through - of course they did.

So, the plot thickens...

We are now getting FACTS... which are always important and relevant before before people [as several have done here] start jumping to conclusions!

Thanks Danmand for getting the lead on this... but why start another thread?

obviously she was fucked up, and the family is just looking to cash in. Niw I believe the hospital. they wouldnt try to discipline a suicidal employee.

Riiiight. No proof, just speculation from an Indian news source, but of course you'd believe it.
Like I always say, the truth eventually comes out. the media just looks to create public anger by sensationalizing things, forget about logic they just play on emotion and everybody falls for it

Why do these things have to be exclusionary? Subject to depression; cruelly taken advantage of by the DJ's;, feeling that she had betrayed her own standards, the Hospital and the Duchess; the Hospital not have disciplined her all can fit together as far as I can see.

Of course it remains to be seen what action the the Crown Prosecution Service in the U.K. decides to take, what action prosecutors in New South Wales, Australia decide to take; and what action the Australian Media and Communications Authority decides to take.

You always say, do you? Yet you are saying she's 'fucked up' and 'the family are in in for the money' based on inferences, beliefs and maybes, from a press that ranks in the bottom thirds in freedom and reliability, just above Russia; although well north of Belarus, which is 168th out of 170 countries.

I don't agree.

The fact that the injured party is peculiarly vulnerable relates only to the extent of damages that may be awarded in the sense that "you take the victim as you find her/him," and not to the issue of the nexus between the impugned act and the injury which addresses the question of liabilty.

If I do something that is "perfectly legal," normal or reasonable but someone suffers some injury because s/he is peculiarly vulnerable to whatever I did, that does not establish liability.

If I commit some tortious act that injures somebody but the injury is greatly more extensive than might reasonably be foreseeable, then, in some exceptional circumstances [too complex to go into here], I may be exposed to a much larger award of damages even if the extent of that injury was not reasonably foreseeable.

I recognize the points you are making Perry.

However, I still believe that criminal charges may well be forthcoming in both England and Australia and further her family may have a civil case against the Station and DJs.

Are you 12? My apologies to those who are 12.

You 'are' relaying on a media reports, but call them all scum.

Considering the story has only been out for less than a day, don't count it out, or a retraction.

Seems eminently unreasonable...

If you cannot establish civil liability on the bassis of the facts, how are you going to establish criminal liability upon the same, identical facts?

Because as I've already stated the suicide is but a small part of it. Having said that shall we agree to disagree.

Merry Christmas.

It has now come out that Jacintha Saldanha, left a handwritten suicide note which in part read "I hold the Radio Australians Mel Greig and Michael Christian responsible for this act. . .Please make them pay for my mortgage."

She also said that she did not blame either the hospital or her co-workers.

It also appears that the King Edward VII Hospital was unaware that she was considered at high risk for suicide.

So? The DJs aren't in any way responsible
We've been over that point ad nauseam and there is plenty of disagreement with your position.

Further it was unknown to those outside the investigation before today that her suicide note blamed the D.J.s and said nothing but kind things about her co-workers and the Hospital.
