Unwanted noise - I've experienced all kinds of unwanted noise in the various abodes over the years. One time I lived on a floor below that of a young couple (MF). Yes, the F was a screamer when they were doing "the deed", usually when I was sleeping or trying to sleep.

BTW: Have you considered renting to a refugee family at nominal or no rent? You will make a lot of liberals happy.

I know, but I'm the type of person who explores every option before giving up. Let's see what the lawyer says.

Furthermore, when I did my inspection last night he started in again about not compensating him. It got heated as he started lying about basically everything, including how his old landlady came to him in literal tears as she felt so bad having to kick him out due to their selling the house. He also told me she'd called him after speaking with me to tell him all about me and what I said. This after admitting that he pretty much heard everything I said to her anyway. With each lie my anger rose. This all started because he wanted to know why I felt the need to inspect. I told him that pet owners don't always take responsibility for their pets and any damage they may cause and that frankly his former landlady told me he wasn't the tidiest and that she'd done the same. I left telling him I'd see him next inspection.

He left very shortly after that to retrieve the kitten he'd removed from the house the evening before because he didn't want me around it, slamming the door on his way out.

I noticed that the whole time I spoke with him he kept his hands folded under his arms and when I asked for evidence of one of his lies, pictures I believe taken the second last day of the drywall repair, before the final cleanup that the contractor asked me to witness so as to avoid any more egregious complaints from him, his hands were visibly shaking. Not certain what to make of that.

If I could afford to Id consider it, but as Phil C. McNasty pointed out, my rent from the house needs to cover my rent on the condo or apt. Despite what some may think of us on this board, we're not all independently wealthy. :wink:

Meh, I see what she's saying though. Men and women, on average, live different lifestyles. Not to say that all men are rambunctious slobs, but they do tend to be harder on a place than women

Its just funny how everyone else can make stereotypes of white guys, but when it comes to the reverse suddenly thats not allowed.

I'm just pointing out the obvious, which I'm sure most Libs wont like :D

If you rent out your own condo, and rent out part of your house, you're not doing too bad.

You are well ahead of the Canadian poverty line.

Everything is not Liberal or Conservative...life is more complicated than that. We should try to get along and not be so ready to criticise someone else's predicament.

As I said before...be careful with this client...keep your head cool...don't make drastic decision. He might just be playing you and your emotions...waiting for you to make mistakes and he swoops in and fleece you some cash...playing difficult with the landlord from the get go, doesn't sound like a tenant was simply an a-hole...it could be done on purpose to see how you react. Always be one step ahead. Never play fire with fire...most of the time both get burnt.

Spoke to a lawyer today and she told me to continue documenting all the times they've disturbed my sleep coming and going at all hours of the night and early morning and the times the kitten knocks things over making a crash, etc. and then file an N7.

Here's an idea....

Dress very suggestively and provocatively. Make advances. See if he shows interest. If he does, fuck him. Then report that you were raped. There is no way he can live in the house if he raped you.

When it comes time to testify say you are fearful for your safety by going through with the case.

Tenant from hell

Has anyone here ever worked for or does work for or know of anyone that has/does work for the Landlord and Tenant Board?

I have a tenant that while not breaking any laws is pushing the fold on many.

My real estate agent specifically told him when he showed him the place that I much prefer a single tenant. He purposely withheld the fact that he has a long time girlfriend, who spends much time with him from us. I tried reaching his then current landlord(s) to no avail. Her VM wasn't activated and she didn't respond to my text. The cell number was later inactivated. I used his facebook page and my agent's gut instinct to rent to him. Interestingly he took his facebook page down after I told him it and my agents take on him was what got him the apartment. It's all very sketchy. Turns out he's a good actor.

The day before he was to officially move in he asked if he could move some big stuff due to not having access to a truck the next day. I agreed and he then proceeded to stay the night, in effect moving in early. His not so quiet girlfriend comes over/stays over more days and nights than not. He's also given her a key as on occasion she lets herself in during the day when he's not there. He immediately got a kitten and then tried to hide it from me and outright lied about it when asked, even though I have a no pet clause. He opted not to go through his insurance when I had my insurance claim and subsequent repairs done and then had the nerve to ask me for money. He's 25 and only ever rented once before and briefly.

Through an interesting set of circumstances I was able to locate and talk to his previous landlords(s). It turns out they asked him leave for the very reasons I'm having difficulty with him, minus the kitten. It makes me think that she purposely avoided my text as I wouldn't have rented to him with the knowledge she imparted to me during our belated conversation. Lucky me, after that experience he came to me armed with his rights as a tenant and proceeded to take advantage of every one of them, basically pooping on me and my agent, who feels duped by him as well, or should I say them.

At the very least I'm going to try to get compensated for additional utility use. I have been loosely documenting when she's around, but unless I install a camera it's next to impossible to know for certain all the times. I don't want to rent to him past the end of his lease but am not certain if I have the right to not renew with him, basically getting rid of him and his lies and complete BS or if I'm stuck with him should he choose to stay. One thing's for certain, if I can't get rid of him I'll raise his rent, unlike with my other tenants who don't cause me grief. I also obtained a reference letter from the previous tenant of four years stating that I'm an excellent and fair landlord.

Any help/advice is appreciated!

Basically, when his lease expires, he can choose to continue month to month and as long as he continues to pay rent you will not be able to get him out unless you or a family member are moving in and give the appropriate notice.

this is 100% true. once you rent to them.....they can continue to be there....even if they don't pay: as long as they eventually pay back the balance they don't need to leave. A ton of scammers out there right now

As someone who has been a landlord in the past I can sympathize. In my situation I actually had to go to Superior Court to have them evicted it was so bad. They ended up causing significant (>$5K) damage to the premises.
Now in your case the tenant isn't as much of a nightmare, but since the apartment is part of your house they don't have to be an absolute nightmare to cause problems. Making noise late at night being one of them. Let me address your issues as I see them
1. No pet clause. As others have said it doesn't have any teeth. You cannot forbid a tenant to have a legal pet. You're out of luck here.
2. The girlfriend issue. If his girlfriend is basically living with him and you have proof (camera footage is sufficient) you are well within your rights to ask for a bump in the rent to compensate. When you negotiate rental price did that include utilities? I think a better way is to separate the rent from the utilities and have them pay a percentage (for basement usually 1/3 of heat and hydro). That way if a situation like this occurs and utilities rise they are at least paying a portion of the increase. I'd also look into separate meters if possible. The incremental cost of that will more than be recouped when you eventually sell the property.
