You are missing the point. A violent act aganst a gay or black or jew etc is not necessairly a hate crime and not necessairly charged as such. A crime which is motivated bu hate of a person becasue he/she is amember of some group may be. It does not make something a crime which is not itherwise a crime. It may affect sentencing.

Not preferential at all. If something is motivated by hate it may be deserving of a harsher sentence. Are you against that?

Every assault is done out of hate, whether thats against gays or heterosexuals.
