"The standard for committing someone to trial after a preliminary inquiry is whether there is evidence by which a reasonable, properly instructed jury could convict them — different than the guilty beyond a reasonable doubt standard at trial." Evidence sealed at this point although the cell phone video of the shooting had to be a big part of why the judge ruled the case is going to trial sometime in 2015.

If there wasn't a video this news article wouldn't even have existed... eyewitness accounts would have been ignored and he would be back on the streets with a gun.

So the inquiry has stated that JF will go to trial for the charges he's been accused of. Wow.

A large number of members thought this wouldn't happen. Then again, there are some on here who believe if he's found guilty, his sentence should be spent in General Population,

I believe the argument was that it is impossible to prove that JF had any malice towards SY, because JF was there as a part of his job as a police officer. Anyways, we`ll see what happens.
and that`s why the 2nd degree charge for sure.

Six posts in, Nuttyboi was claiming the the whole thing would be whitewashed and swept under the carpet. He went downhill from there after buffing off his Magic 8 Ball.

Are you saying that prosecutors charged JF with this knowing that it will be difficult (if not impossible) to convict?
Isn't this the point of the preliminary inquiry committing the charge to trial?

So you're saying that the prosecution found fault with the way JF conducted himself during this incident?
Since I don't have all the evidence in front of me, i can't answer that properly.

If they really wanted to convict him, the judge would say the 2nd degree would not stand at this point and the crown would have been FORCED to change the charge to Criminal Negligence or Manslaughter. Those are 2 charges on which there is actually a risk of conviction. 2nd degree, zero risk of conviction. Guaranteed walk. 2.5M for a show? You really think they care about 2.5M? It's a well known figure offered up for the average cost of a capital case in Canada and most recently, a conservative guess in a Waterloo regional murder trial. Yes, we don't know the exact cost, but an average is a good start.
