Incall is not illegal per say. Some can be, some are not. You may wish to become familiar with Toronto laws before making foolish comments.

And I have no desire to go into the definitions of what makes a good in-call turn bad and become illegal. Dig into your wallet and ask a lawyer.

The police respond to complaints. Incalls is not their priority. When an incall gets busted 99% chance the "complaint" came from a competitor. Most likely certain outcalls who do their best to destroy any competition.

Incalls are not illegal? Where? in Brazil? In Toronto they are VERY illegal. If exchange any sexual contact for money it will be illegal. You can't even lap dance anymore.

Here's why: unless they receive a complaint, as stated, the police have more important things to do than bust 2 consenting adults having sex.

As for illegal, you can hardly compare incalls to child porn, selling and discussing how and where to get drugs illegally and other illegal activities....

As stated, the police don't look the other way, they just don't look unless they have reason to. For eg: neighbours complain, rumors of underage ladies, abuse etc.

The prostitution laws are very specific on this matter and it is not the sexual contact for money that is illegal, it is specifically: discussing sex for money in a public place, living off the avails (as discussed here) and keeping a common bawdy house which loosely means: having a location for the specific intent of having sex for money that is a) the lady's residence and or b) not the lady's residence yet customers go there to complete the transaction. Discussing sex for money and having it occur in your (the customer's) private residence is NOT illegal (aka outcall).

As for asylum's comments: I take it she's NOT an escort? You see, it is easy to arrange a car and driver to take you to a club where you will be working for x number of hours. Do you dance for an hour at 10 clubs per night? Do you dance at 50 different clubs per week? You see, arranging for a car and driver to watch your back while you work is totally different than having someone take you to point a then pick you up 6 or 8 hrs later and take you home. Heck, a cab driver would work fine. However, having a driver on call for 8 hrs, and paying him to be there for you if problems occur, that's a whole nother ballgame.

So you say one can pay someone to build and maintain a site for you, hmmm sounds like he's living off the avails doesn't it? Hmmm sounds like something an agency owner does.

I find that you have the "ostrich with it's head in the sand" attitude: just because it works for YOU, you can't seem to see that it might not for everyone. Some don't have the time nor the inclination to do it all for themselves. This is why we have many different types of industries and careers. if everyone could do everything for themselves then the economy would collapse. ie: Why pay a contractor to build you a home, heck just do it yourself! Why pay a mechanic to fix your car, just do it yourself. Why pay a lawyer to represent you, it is within the law to represent yourself....see what I mean jellybean?

Fnd a criminal lawyer. Give him money. Ask him if a hotel room used by a hooker for 2 or 3 days as an incall is by definition illegal. A lawyer will explain the case law to you, not just quote the Criminal Code. Your opinions are very interesting but not basd on facts or knowledge.

Well not sure about Canada but here in the USA its not the lawyers who decide WHAT the law saids, its the Judges.

Which explains why some places are different than others.

You can find a lawyer who will tell you what you want to hear but that doesn't mean a judge will agree with him, lol

Yes but its the judges not the lawyers who call the shots.

Not all agree with every lawyer views. Which is why it matters WHO is a judge.

Believe Canadian law is the same as the USA when it comes to that.

Not all judges agree with each other too, which is why theres higher courts.

Which is why sometimes it takes so long for the law to change. Even IF the sex trade workers win their court case, the city-crown-whoever-might appeal it to a higher court.

To the best of my knowledge, no hotel room in Canada has ever been found to be a bawdy house. There have been cases of motel rooms used for a couple weeks being held to be a bawdy house.

But I don't think an actual hotel room has ever been found to be a bawdy house, a few days wouldn't be enough anyway, and certainly not the upscale downtown hotels that are used for incalls, its never happened.

And you didn't have to give me any money. :)

Now that I think more about it, say the police did claim that room xxx was being used as a bawdy house at the Sheraton on Queen st. What do you think the lawyers that work for the Starwood hotel chain think about it ? They have a fit! They might very well fight the claim also.

Can't bawdy houses have the places taken away by the police? That Sheraton hotel is worth BIG bucks. I can't see that happening.

This might explain why the cheap motel rooms are not used much-and never by the big escort company's. Those "little" owners can't fight back like the big chains hotel chains can.

Maybe the Toronto police are not turning a blind eye to InCalls. They just can not seem to legally be able to stop some who "play their cards right".

I do know 1 thing lol, some of these big escort companys must make a TON of cash. Sure they have a team of lawyers to back them up if need be.

I would not go that far. In Windsor Canada there is no or very few InCalls and no escort companys do any InCalls. The Windsor police-and the local judges-come down very hard on that. Escorts themselfs even need a license to work as an escort.

Its the local judges that allow or disallow what goes on as far as InCalls.

OutCalls-well the Supreme court of Canada has OK it, so theres nothing the local judges can do now about it.

Which brings me back to think WHY doesn't the police might not want the Supreme court of Canada to rule on InCalls. If the police lose :eek:

Actually I think you are right. Well a few were named in charges but it did not hold up.

Rule of thumb.... multiple girls are sort of needed and it must be habitual. Internet allows everyone to easily look up the criminal code, but does not provide the case law. So we get a lot of odd beliefs sprouting as truth.

Some people do not even know that large parts of Canada are under the Napoleonic legal system, not that weird perversion the British invented.

I don't really know why it is so important to you but since you keep bringing it up there are some points that you don't take into consideration as to incalls:

Get used to it, incalls are illegal and here in Toronto at least, unless the police receive some sort of a complaint, they don't worry too much about them.

As for a hotel room being used as an incall: The police cannot sieze the property as our seizure laws are entirely different than you have in the US. Even if they weren't, the police would have to prove that the owners of the hotel or property were unequivocally aware that it was in fact being used as a bawdy house and continue to allow it to operate after discovering the purpose.

Now it is very difficult to prove what a person knows or doesn't know. The only true way is to have a witness testify that they were present when the owner/manager of the hotel was present when a person gave another person cash and then proceeded to couple in front of the manager and the witness. Otherwise it is just hearsay which is NOT admissable in court.

Another way to prove it is to produce a document that has the owner's or manager's signature on it and contained in that document is notification that the hotel room is going to be used as a bawdy house.

Same goes for rental properties. In most leases it specifically states that no illegal activity is permitted on the property and that the property is to be used only by the person on the lease or family members or occasional guests. (this is negligable). If the landlord or property owner discovers that illegal activity is going on then they have the power to immediately evict the tenant(s). Again, unless there is a witness that will testify that the property owner was present when someone paid to have sex with a non tenant, then it is hard to prove they knew it was going on. Now even then they couldn't seize the property they could only charge the owner (but if someone knows more about our seizure laws, feel free to correct me).
