Fractured skull and intensive care and who knows what. So basically someone tried to kill a would be robber. With a bat. Self defense is one thing, but being pissed off and chasing a guy down the street and trying to kill him is a step beyond.

The junkie tried to kill the clerk first, totally justified.

I think they were correct to charge the clerk with aggravated assault. At that point he was no longer in self defense mode. That being said I think that the Crown should take mitigating factors into account - the clerk had been assaulted with the bat, he had been robbed and traumatized and was likely running on adrenaline when he chased down the suspect.
