Yes, save in extraordinarily unusual circumstances appeals are based upon errors of law, not of fact, and certainly not the Judge applied the law accurately but quite strictly and I feel that's grossly unfair.

You are mixing up legal and non-legal terms. Of course she can consent to have sex, just like she can consent to anything else. You are choosing to view the title in LEGAL terms , but in non-legal terms you can walk up to her, ask if she wants to have sex, and if she says yes than she has consented. It just won't be a legal defense, and she will be DEEMED to not have given consent in a legal proceeding.

It is the Legislature (with the approval of, or overriding the veto of the Governor) who enact laws, the Judge merely enforced the law.

Saying the Judge is a no good bum who deserves death, is vastly different than saying that you feel that all 50 U.S. States should allow a defense of reasonable effort to ascertain whether the other party was of age.

since the system seems to provide no good oversight. He jailed a woman illegally for 10 days and was censured? How about at least a 10000 fine or 1 year suspension. A young mans life is destroyed. To me what he has done is akin to murder. With his level of knowledge and training this accentuates his crime. When the system fails, other checks which are less preferable, will happen. If someone knowingly and willfully ruined my life that way I would seek them out and ruin theirs. Yes I would. After all, what do I have to lose. (if I had no legal recourse)

My understanding and I am not a lawyer is that an appeal can only be launched on technical and legal grounds... That is the trial judge misinterpreted the law, did not follow the rules of evidence, ignored court procedure, etc.... From what I understand, not liking the ruling or calling the judge a boob is not grounds for appeal.
I am not a lawyer either but I believe the agreement & verbal exchange involving the defense, prosecutor and judge are the basis for the appeal. If I was launching an appeal in the arena of lawyer wannabes my objection is the premise the judge gave for the sentencing penalty.

"At sentencing he told Anderson, "You went online, to use a fisherman's expression, trolling for women to meet and have sex with. That seems to be part of our culture now: meet, hook up, have sex, sayonara. Totally inappropriate behavior. There is no excuse for this whatsoever." He is moralizing on a totally legal activity and strongly suggesting that he penalty is meant to dissuade this activity without even mentioning the underage infraction. He could have said 'I hate plaid shirts in a court room' and sentenced him to life imprisonment. I don't think legal activities that the judge doesn't morally approve should be provided as a basis for sentencing.

In some States Michigan being one of them, New York being another.

Personally I despise judicial elections vastly preferring nomination by the Governor (with the advice of a Judicial Selection Committee) and conformation by the State Senate.

How does voting him out of office undo the damage he has done to this kid? Who said I am worried about the govt watching me? You think we live in Nazi Germany? The reason gun ownership is guaranteed by the US constitution is to serve as a check against tyranny. Destroying people on a whim is tyrannical.

This young man, at 19 certainly not a kid, sexually assaulted an underage girl. We have strong provisions against such behavior in part because adults can groom and manipulate children to make them think they are consenting.

If you removed the strict liability you would have all sorts of pedophiles claiming they were having consensual sex with kids they groomed to "consent".

That is why a JUDGE is supposed to JUDGE the circumstances. If the parents of the girl oppose the outcome, it is probably the wrong one. I understand why the laws exist. I also understand why we expect high standards from judges to make the right determination for society in these cases. They do not always do so. In some circumstances it is well beyond incompetence and willful. If I was the victim of such circumstances I would seek retribution personally if no legal recourse was available to me.

It's a legal term because society believes someone that age does not have the capacity to consent. Her saying yes is meaningless. She cannot consent and therefore it wasn't consensual.

This is absolutely ridiculous. Of course they need laws to protect underage girls but in this case, the punishment doesn't fit the crime, not even close.

Years ago I was being hit on by a very attractive, smart, articulate girl. She bought us a couple rounds of drinks and after last call she suggested we go back to my place. We had an awesome night of sex and again in the morning. She was very experienced to say the least. I drove her home the next day which is when I asked her how old she was. She said "you're going to kill me, I'm 15 but I'll be 16 in a couple weeks." Oh Lordy!

Thinking back I probably should have asked her age before we had sex, but there was absolutely nothing about her that made me think she was anywhere close to that age. I believed she was the same age as me, which was 20 at the time.

I feel for the guy. What an awful injustice IMHO.

If I firmly believed someone had ruined my life, and I had no legal recourse (and it was a wilful act, not through accident or omission), I would personally seek retribution. What form that retribution takes I dunno. But at the end of it, we will both be seriously fucked or if I fail I would be dead trying. I am not talking about just pissing me off, I mean taking my life to a point where it was not worth living. If they seriously piss me off, I would live my life and maybe take revenge if I found out I had a terminal disease.

The laws vary from jurisdiction to jurisdiction. In Michigan sexual intercourse with a girl under 16 is rape. Period. No exceptions, even if she consents. An honest belief that she is of legal age is not a defense. Sexual contact short of intercourse with a girl under 16 is a crime if the male is five or more years older than she is.
That's a big problem in the US. You have 51 different versions of the phrase "rape" .

The US has some strange laws ie: you can go to war,get killed at 18 but can't vote or buy a drink in some states until you turn 21
