IANAL, but I think it has to be "plain view" to the public, not just from your private property. I can't video tape my neighbour's teenage daughter sunbathing topless in her backyard, just because I can see over their 10' tall privacy fence from my third floor window.
If you have a drone you can as long as you are flying over your property and not higher than 30metres/100feet.

As a photographer, I’m going to way in on this. We as a people have no rights to our image if we are in a public place,] this includes privately owned places where the public gather ie malls, stadiums and the such. However you are protected from someone making a monetary gain off your likeness without your consent or an attempt to gain it. If you are on private property, you have the assumption of privacy, the courts have basically extended this to elementary schools also, which basically means you can be charge with a variety of offences for taking pictures of people there. The drone is not a special case, the person has taken precautions to create privacy (a hedge for example) you take a picture you are in violation.
