I am impressed. The defence team has taken an embarrassing, hopeless train wreck of a case and made it into an even more embarrassing, even more hopeless train wreck of a case.

Pretty much. There is method to the madness.

The defence is trying to provoke, insult and anger the judge and get him to make mistakes, which they can then appeal. It means that they are sleazebag shysters who realize the trial is not winnable by ordinary methods and are trying to cheat their way to a cheap win. They could well end up getting sanctioned and cited at the end of the trial.

If the judge can keep his temper, he can just ride through the insults and provocations, shrug off their bullshit and it's still a slam dunk for the DA.

The downside to "judge-baiting" is that if the judge keeps it together, your client gets convicted. And when your client gets convicted, the judge controls the sentence. And any point along the spectrum of "reasonable" will withstand an appeal hearing on sentence - especially if the Court of Appeal bench picks up scuttlebutt about the judge-baiting either from gossip or from simply reading the transcript of the hearing. If THAT happens, the CA is quite capable of being creative and "reasoning" that even a viciously cruel, overly harsh and ballbreaking, swingeing sentence from the trial court is "perfectly reasonable, generous to the accused even". (LOLOLOLOL - we're having our own little judge chuckly joke here). The Bench can create its own "alternate reality" by just pretending and frequently does, if it wants to send a message by hammering someone for sketchy behaviour.
