Are you really trying to claim that a professional standards board is a dictatorship? Have you missed all the posts about how these organizations work? They are all run by ELECTED bodies. You know, democracy.

But we both know your pull out the word 'dictatorship' simply because you don't like professional standards.

Yes, that's what JP is trying to prove. That the CPO is a "dictatorship." That's why JP is taking the CPO to court.

Doc Pee tosses that word at the rubes to get clicks, followers and funding. No judge is going to accept that it's a "dictatorship" because you're being told what to do by a public body. Judges a pretty damn good at ordering people around themselves and it's not a great idea to call your judge a "dictator". (Of course, when he / she gets through flaying you, he / she will probably have a few chuckles about what you said and what then happened to you over gourmet sherries at the next judges' cocktail evening.)

Levitt is a solid lawyer, although a little out of his field in public law. But he's competent enough to argue the following:

That forbidding Doc Pee to expound on trash social media about professional topics he knows nothing about is insufficiently closely connected to the core interests of the psych profession to pass the "freedom of speech" test and that the regulations and the way the CPO enforced them were "unreasonable overreach".

That's the insider's argument. The CPO will argue that they forbid the same shit as every other CP in North America and Div Court will hear argument and think about it.

Hi Mandrill. First of all , I respect you 100%. I know you're a lawyer in real life, and I also know you're at least 50 times smarter than I am. With that being said, I just think the CPO has a weak case. I don't want to go through the reasons again, as the google doc of JP vs CPO, covered everything. For some reason that google doc, seems to be offline now.

Knowing JP's controversial personality, I can't see JP meeting with either one of these two ladies for social media coaching.

Mandrill, as you correctly said , JP will have to get a top lawyer like Howard Levitt, or some hot shot constitutional lawyer from top law firms, such as Osler's. Goodman's or McCarthy's, to defend him in court against the CPO. Luckily for JP, he can certainly afford their legal fees!!

I don't think I'm that smart, but thank you. We'll see what happens. The Bench won't like Doc Pee very much and they'll want to cut him down. OTOH they might bite on the free speech argument.

The 3 firms you mention are corporate law firms and wouldn't necessarily be my first choice. That said, I don't know off hand who I'd choose since this isn't my normal field.

He know that the CPO is nowhere near a dictatorship (he's smart enough to actually know what the term means) but he also knows by throwing around the term, the suckers will continue paying his bills.
