These days we have Uber, there's no excuse.

Contrary to the scofflaws who think everyone has driven drunk, I never, ever have. It's a really easy thing: if you are planning to drink, don't drive. I'd you are planning to drive, have one drink if that, to be social and stop. It's really not difficult.

If you are physically unable to stop yourself from drinking they you're aa problem alcoholic, you should go to rehab, join AA, and you should never have another drink in your life ever.

The same batch of scofflaws are out saying that consensual sex between two adults is just like putting lives at risk by drunk driving. Not sure if they're serious or just trolling.

Maybe in the future we'll have self driving cars and you can sleep it off in the back seat while your car takes you home but until then if you are planning to drink, take Uber.

People don't realize how much you have to drink to reach .05. One glass of wine simply won't do it.

Blowing over .05 in B.C. will only get you off the road for 24 hours. You have to blow over .080 to get into Criminal Code drunk.

Refusal is the same as being over. Cops love getting people who refuse. It's easier for them than if you blow. There's no recourse for refusing and it's been held up by the Supreme Court, so you might as well blow and take your chances.

You're probably right that it's more than a glass of wine.

As an example, and yet ANOTHER employee (not while on the job), told me that he got caught with 0.05 and suspended for 3 days. He said he drank 3 beers (he said that he wasn't planning on driving so soon from a picnic with family, but had to leave earlier for some important reason). But I personally doubt he had 3 beers and think it was more.

I agree with Lucky Blue and nottyboi about MADD. It's gotten off course. If you say you have a glass of wine for dinner at a RIDE, they will ask you to blow and if you refuse, it's almost as worse a charge. Social drinking is condemned it seems.

I remember an age where they would say "Drink Responsibly", but they don't say that anymore. The limit is down to 0.05 for a lesser charge.
You should never refuse to blow, it's a serious charge. And you should never be in a situation where you have any doubt at all what the result will be.

(I took the TTC to a meet and greet. Again, didn't drink much but played it safe. I parked at a subway station near home which allowed any more BA to oxidize. Probably should've Ubered or cabbed it to the subway station to be ultra safe.)

I bet that cop was checking to see if I'd refuse to blow. I couldn't believe that I was 0.00 (she showed me herself). I finished a Manhattan cocktail an hour earlier. Not worth taking chances though.

I really don't drink. Not a big drinker. I can't drink much either recently (no more than 2 drinks) due to my medication for controlling blood sugar.

Worst advise anyone could take is this.
The whole one drink and you are fine to drive or one drink per hour and you are fine to drive is 100% wrong. The alcohol needs to burn off and only time will burn that off. The average male will burn off one standard drink every two hours. So to say you can have one drink and be social and you can drive safely is 100% wrong.

I remember reading a study a few years back that stated cops estimated 60-70% of drivers who drink and get behind the wheel never get stopped. And the majority of you hollier than thou guys who claim you have never drank and drive are simply lying because having one drink and getting behind the wheel is drinking and driving.

I can't begin to think how many of you take a bottle of wine when having appointments with SP's, have a glass or two prior to getting behind the wheel of your cars? So stop this hollier than thou acts.

You need to get a criminal lawyer to handle this charge as DUI is a criminal charge.
Also your blood alcohol level reading is important on what the lawyer can do and also some municipalities are a little more leanient towards drinking and driving but speaking to a lawyer to handle this is a must and they would be able to give you more information, but be expected to pay $15000-25000 in lawyer fees, fines, and insurance premium rate hikes within the next 1-2 years immediate expenses.

BTW don't listen to the douches who claim they have never drank and drive. The majority of drunk drivers never get stopped by the police. Some of these posters who have the hollier than though attitude have nothing better to do in life than to post obsessively on TERB on every subject with their opinions to make themselves feel knowledgeable and more superior to others. Quite frankly anyone who posts on average more than 5 times a day on TERB needs to get a life. Regardless of the hollier than thou crowd drinking and driving is a stupid thing to do but learn from your mistake, deal with it and never do it again. To pay $100-200 for a car (taxi, uber, limo) to be safe is very little to pay and saves you from so many headaches.

What happens if he just pleads guilty, period.

Does it lower his costs?
Will penalties be more severe?
Nothing will change he still needs to pay for a lawyer which fees don't change and also his insurance premiums will still go up the first 1-2 years will cost him quite a bit, but that is a very small price to pay for drinking and driving. He should be happy he didn't hurt anyone in an accident

BUT is having that one drink going to bring you over the limit? (Fuji's 1 social drink limit implies that most people won't. Remember, the current laws are not an outright prohibition; that is, it's not a "if you have one drink, you are guilty of impaired driving".)

He can plead guilty with no lawyer...of course, and save that cash.

the set fines, interlock device, etc... Are all same costing.


Now many lawyers will tell him he can beat it.... Charge $7,000 and more to run the trial.... And still lose. In that case, fines may be higher as the client did not plead at first available opportunity and is showing little remorse by fighting it. The attitude is reflected in the increased fine.

Some people can have two drinks and feel woozy already. Some guys can drink all night and are fine.... must have godly alcohol resistance. The better ruling would be for cops to judge if someone is toast or not regardless of the 0.08 rating.

So you want a subjective measure used instead of an objective one? Instead of depending on calibrated instruments like breathalyzers, you want some cop whose level of training may or may not be good putting you through the court system instead of going by medical research? You are blasted at 0.08. Not only that, compared to other countries, that's a high limit. There is more case law on drinking and driving than any other crime in the Criminal Code. You're saying you'd rather go by one guy's subjective evaluation of you than what has been established by the Supreme Court? Are you also aware that there are two charges in the Criminal Code for impaired driving? Impaired and over 80. You don't have to be over 80 to be charged with impaired, which covers off those who can't drive properly below .08.

I had one drink and got behind the wheel an hour later, and the cop showed me the reading was 0.00 (frankly, I didn't believe it myself and thought that she was testing me if I'd refuse). Not something I'd like to test again and would rather play safe.

There should be no sympathy for first time offenders. You make a conscious decision on how much you are going to drink before you get behind the wheel. A drunk driver is just as dangerous as someone with a gun who doesn't use it responsibly.

Over 130 deaths occurred from drunk driving every year from 2008 to 2012. I would bet my paycheque that half were caused by people never caught for drinking and driving before.

They are not equal acts in terms of danger to the public.
How many people had a chance of getting maimed or killed during your last session with an SP?

For sure it's a matter of degree, but my point is that a bunch of people who engaging in something that is very morally wrong, keep stating the obvious, that he made a poor decision. We all know he made a poor decision, and now he's seeking help, so either give him feed back to help his situation that he requested, or move on as this board isn't filled with the church of latter day saints. These guys that are saying they want the book thrown at him, I wonder if their wives would feel like they're lives have been ruined knowing that there husbands are out conducting themselves in illegal activity, not to mention cheating on them.

Are or are not people killed by drunk people? Are there or are there not people who are seriously injured by drunk drivers? Even if you half the numbers, they are still significant even if you think they are lying about them. You honestly think that instead of 130 people a year being killed in Canada, there were less than 65 each year for a 30 million population? You find that an acceptable number? It's still higher than the number of people just killed in Orlando.
