This is not good although I do think it would be a bit of a bit of stretch to indict Governor Spitzer under the current wording of the law:“Federal prosecutors rarely charge clients in prostitution cases, which are generally seen as state crimes. But the Mann Act, passed by Congress in 1910 to address prostitution, human trafficking and what was viewed at the time as immorality in general, makes it a crime to transport someone between states for the purpose of prostitution. The four defendants charged in the case unsealed last week were all charged with that crime, along with several others.
The infamous Mann Act was another example of “Do Gooders” at work. It was enacted in 1909 as a result of the "white slavery" hysteria of the first decade of the 20th Century. The press fueled hysteria with sensational stories of innocent girls kidnapped off the streets by foreigners, drugged, smuggled across the country, and forced to work in brothels. Although designed to combat forced prostitution, the law was so broadly worded that it criminalized consensual sexual activity - the “or for any other immoral purpose” clause. Ironically (but perhaps predictably) the newly formed FBI (then just the BI) was unable to find any evidence of widespread “white slavery” (because it wasn’t there).
