No, he didnt keep the insurance card. He gave everything back to me.

Yup. Sometimes can take up to 2 years to get the tickets listed for your insurance. When they are listed though, bend over......

Some carriers don't even take people with 2 tickets now, may have to go with a higher premium carrier. Had a friend who got nailed with that, doubled her insurance.

I believe the fact that you got those tickets will already be on your record. If you don't disclose that you have been charged to the insurance company when they ask (and they will, especially since you've only been driving for 4 years and don't have a current policy) then that is fraud and they will most likely cancel your policy when they find out. Good luck finding insurance then.

IMO you should pay the tickets and count yourself lucky. WTF do you think would have happened had you caused an accident while you were driving with no insurance?

You chose not to renew your policy and since I'm pretty sure your insurance company would have let you know it was coming due well before the end of the month, you have only yourself to blame that you can't get insurance because everything's closed.

gl: 1st renew your insurance policy, you don't have to say anything to the agent about the ticket because you have not been convicted, 2nd within 15 days of receiving the tickets go and plead not guilty on both.

I agree with part 1

For the second part f you plead not guilty and anyone notices it was not the $65 offence but the much more serious -no insurance you might be facing a much more expensive charge. To quote good old Dirty Harry “Feeling Lucky?” For $65 bucks just take your medicine and thank your lucky stars the cops was being nice. Pay the fines in 14 days.

Man pay the insurance ticket and fight the speeding if you want. Ignorances really doesn't hold up well in court. :rolleyes:

You really can't say you were ignorant of that law anyway. Clearly you knew what you were doing but you just thought you wouldn't get caught.

How is driving without insurance only a $65 fine ? I can't believe they let you off that easy . Pay the fine and keep your mouth shut because I can only see bad things happening if you were to fight it in court . This is a very cheap lesson for your incredibly bad judgement in driving a vehicle without insurance . BTW 4 years of clean driving isn't even worth mentioning .

Get insurance tomorrow and pay both fines.
For arguements sake, let's say you get insurance tomorrow, pay the 'no valid insurance slip' fine and fight the speeding ticket.
What do you say or do if the judge pulls up your record of convictions and charges, and asks you to show him a valid insurance slip. You show him your new one which will say "Effective Jan 2, 2008" and you can't prove you had insurance when you were pulled over. (Because you didn't)
$5000 fine. You'd risk that happening instead of paying a $119 fine???? Give yourself a good shake!!!!
I'd pay both fines to avoid standing in front of a judge and having him ask me the wrong questions.

I went to court hoping the cop would not show, but he did. Told the prosecutor that I would plead guilty, and leave. The judge still asked the cop questions, how fast was I really going, etc. Thought I was going to get screwed. If this happens to you with no insurance, you will get screwed very well. Know the cops keep written records of what happened when they pull people over. Get insurance asap, pay the tickets, and feel very lucky the cop did not check further, or was in a good mood and let you go.

Come up with a better explanation than that in court is my suggestion.

Also get your new insurance asap and make a point of showing the short delay between it expiring and the renewal...then blame your broker, she wont be there and its plausible. Blame the holiday season, blame Jesus...but dont tell them you failed to renew because you didnt trust your broker.


But more importantly get professional advice, consultations are free and negative consequences are most likely well worth a few minutes of your time on the phone.....unless you make 10 k a minute, then dont worry about it.

Usually once you renew your insurance [within a few days, no accidents during that time + the same company] you'll get an insurance card that covers those elapsed days. I say plead not guilty to both tickets. Forget about everybody else's honesty here, they are not the ones getting the record or the fines.

Go to 123 Edward Street within the 15 days of getting the tickets. Request a trial and plead not guilty. Check off the box that says you want to challenge the evidence of the officer.

You will recieve notice in the mail with a trial date. If the trial date is 11 months - you may be able to argue 11(b). Twelve months is the standard acceptable length of delay. You need to file the approriate paperwork in advance.

If there is any luck for your situation - the officer will not attend the trial date and the charge will be dismissed.

Get your new insurance immediately.

Do not drive an uninsured vehicle again. It will be particularly annoying to the Court if you get charged again. Note: The Edward Street address is just steps from the St. Patrick subway station.

I don't think you can simply pay the fine on line as the insurance ticket is not a set fine payment. I believe the Justice of the Peace has to determine the fine owing based on submissions by Prosecutor and defendant.

Never argue your case with the clerks at the counter at 123 Edward. They don't care about your situation. They do not have the authority to do anything but accept your paperwork for processing.

I thought the OP said the fine for the insurance ticket was $65 (or something like that). If he goes to pay the fine that is asked for, why would it then change?

the moment you plead guilty, you are fucked. They cannot and will not reduce fines or points for a guilty "with an explanation".

If you go to X-Coppers etc, they will say they win, if they get the fine reduced, ie get you 15 over rather than 24 over. By the sounds of it, the cop already gave you a break and told you 24 over rather than 25 over.

As for the insurance, the moment the CONVICTION hits your record, you are severely screwed with the insurance company. Renew your insurance NOW.

The cop gave you a huge break on the insurance thing. Plead not guilty so that a conviction is not registered, then change your plea when you get to court. But get your insurance now. Like, yesterday.

Cop gave him a break and only charged with not producing. Taht is $65. If he gets to a court and details are disclosed you are righ, he actually faces up to $5,000. And if the cop is competent he recoded the information.

So he pays $65 or risks paying $5,000.

not to mention he is as guilty as can be.
