It actually does apply. Whether it was a criminal charge or not is irrelevant; the decision had nothing to do with the charge itself, and everything to do with the interpretation of section 11(b) of the Charter. Morin did not set a specific timeline, it established a set of criteria that must be considered in determining whether an accused's 11(b) rights had been violated.

Sure I will be the one dressed in the clown suit carrying a sign "It was his first time ... Honest... Go easy". In the other hand will be a sign "He was inconvenient for him to get insurance but Keebler say it is okay."

It should help his chances.

I'm glad that everyone have good jokes on my missery. I guess some of Christmas spirits are still around you people.

I'm going to pay those tickets for sure. Regarding for getting an insurance, I have to get a quote first on how much i will be paying on the policy after these 2 tickets. If it's worth it, then I'll buy it. If not, then Im going to take TTC.

I got the tickets on Dec 30th. I worked on the 31st and most places closed earlier. Today is the first of January, and they still closed. What can I do?

Drive down to take care of my tickets? Drive to where? Edward st? I have no insurance!! Beside, I can pay them online as well. But I'm going to call some insurance companies first before I decided to drive again or not.

Not misery so must as stup*****. You knew that you weren't insured, you choose to drive anyway, instead of just playing it safe until you could get insurance, you choose drive enough over the speed limit to get a ticket. You are the author of you own issues here. Then you think you could get a break break it was the first time you caught.

Om a serious note if you choose to not get insurance, pay the money to get yourself insured under some else's policy (parent's) as an occasional driver or the next time you go for insurance you maybe rated as a new driver for not having continuous coverage (I am not kidding).

(Before K.E. says anything... Yes I have got caught bending the driving rules, I have got caught, and I paid the fines...)

I am AWARE about it. You dont have to keep reminding me. I chose to do it and its done. Now, I'm finding the best solutions to ease my problem. Not to be reminded every second that my decision was wrong.

Well if you look at it from someone else's perspective you might say "what a dumb ass" and get a laugh... Not from the pain but I can't believe he actually did that... Like America's funniest video's. Here gl is canceling/lasping insurance, here is gl ignoring that fact he doesn't have insurance, here gl is speeding in front of the donut shop (I can't confirm that.), here is gl talking to the cop, ... From a third party perspective it is fairly comical. Sorry. :eek:

There is a big difference about being a dumb ass and an ignorant. I was being an ignorant, and I knew the consequences, and I took it.
Have a good laugh buddy, since you need it anyway.

So, when I call my broker tomorrow to get it renew, I shouldnt say that I got tickets, because technically I have not convicted yet, until I pay the ticket or the 15 days period over, right? Therefore, I can get the regular premium.

Somewhere but not here.
You chose to drive without insurance and got lucky nothing happened to really need it ... and you were speeding knowing you had no insurance so it gave them a reason to stop you.

The holiday's is no excuse for not having it and no sympathy here. Get insurance then pay the tickets.

Pal all due respect, you are missing the point. YOU NEED INSURANCE NOW. All else is irrelevant at this point. The thing you must grasp is, you were driving with out insurance, they are brutal on this one. Call and take the first price they quote. If insurance asks about infractions answer yes, only elaborate as needed. They will find out anyway, regardless. Get insurance now, all else can be sorted. $5000 fine is for starters. You will need to hire some kind of advocate for sure, unless you want to make situation worse. Biggest mistake you could make now is to defend your self with out real advice. Good luck, you need it.

Go with Redline, I have friends that didn`t have insurance and got off. Courts will definately target you on the no insurance especially when you produced an expired slip to the cop. Did the cop keep the insurance slip?

if you got a citation to appear in court, the no insurance charge is not on your record until you lose the case in court. Insurance companies doing a record check will not find it, they may find the speeding ticket unless you fight that too.

I WILL get an insurance tomorrow for sure. For renewal, they are just going to use my info that is already on their database, and they are not going to ask me questions like "have you ever been convicted?", right??

Am I right or wrong? That I'm not convicted yet by the time I get my insurance tomorrow. They charged me, but not convicted me. Technically, I'm convicted if I plead gulity and pay the fine or doing nothing until the 15 days period over which they will automatically convicted me.

Should I say that I've been charged with traffic violation to my broker eventhough she doesnt ask?

Try it, though. And maybe if you get in an accident and they review the policy before paying out, they won't just decide you were dishonest and void the policy...
