It is funny how people don't read things carefully before they jump all over things. To be honest Ardy I am most surprised by your reaction...I thought you might read the details a little more thoroughly. Let's look at the things that everyone seems to be ignoring:
1) he was NOT convicted of statutory rape. It seems that Germany has a 20 year limitation period for that crime and this case was brought too late. So there are NOt statutory rape convictions in this case.
2) he was not convicted of rape. The judge found insufficient evidence to prove this charge and found that there were many parts of the complainants' testimony were contradictory or not credible. 3) The only thing he was convicted of was incest, because the judge was not convinced that she did not consent.
A three year sentence for incest is not so bizarre in the circumstances.
Of course the article is written like trash, and people who have a bias against Europeans are happy to buy into the bullshit to call them weak, and surprise surprise a brit tabloid likes to take a crack at the German justice system.
But, if you read the article closely, and try to understand what happened...if is not so strange at all.

It is a good question. But the state believed the woman's claim that she has been raped, while the judge found otherwise. To now turn around and charge her as well would a) make them look incompetent, and b) discourage various types of victims from coming forwards. It is one of the reasons you don't see a sexual assualt complainant charged with perjury every time the guy is acquitted.Good question.

I agree with you that these are both rarities. I have no idea of German limitation periods, I just had to rely on the article. And even if I had the transcripts my German would not be up to the task of assessing credibility...Mea culpa, mea maxima culpa.
Still two things that remain unusual in our day: a twenty year statute of limitations on Statutory Rape; a Judge who accepts a "little Lolita" defence.

German laws are screwy as far as I'm concerned on this issue. Incest between two adults is one thing, but incest with a 12 year old, well that's considered rape in my book.
