Stanley’s defence is based on the claim that the gun went off “accidentally”. No one believes that.
You ever shot a rifle before? Know what the average trigger pull weight is? Ever been involved in a confrontation with a firearm? If you've ever done even one of these things, you'd know how easy it is to pull a trigger.

Beyond a reasonable doubt is the burden of proof, which wasn't met.

As someone who has admitted he is ignorant of what rural Saskatchewan life is like and has no knowledge of the low number of officers who police rural areas and amount of time it takes the few of them to respond to calls, you should shut up. You are a world away from their reality.

^^ so for point of discussion you need the ATV (the reason why should be immaterial after all it belongs to you) how are you supposed to immediately replace it if you don't have lots of free cash?

Seemingly the attitude being expressed is tough luck just wait for months for everything to be settled. I'm not saying lets have the OK Corral every day. I am saying that there does seem to be a who cares its only property attitude being expressed which sounds like they have never had the experience of what the Hell am I supposed to do now.

These red neck fucks need to stop killing Native people.

If it’s so easy to “accidentally” fire a gun then buddy shouldn’t have been waving it around in the first place.

PS: Funny how he just “accidentally” shot Bouchey in the back of the head, hey?

So Stanley was spared the inconvenience of having to go through an insurance claim to replace his atv at the expense of a human life. He must really love his atv.

It was murder plain and simple.

Exactly.

Jury even had the option of convicting on Manslaughter but they didn’t.

Racist assholes...If it was a bunch of drunk white kids who tried to steal an atv the outcome woulda been different.

These are the types of stories I like reading, as it shows stupidity across all spectrums:

- Bunch of young people goofing around a night of drinking
- Seemed like one them tried to steal an ATV
- Gun-toting owner goes ape shit and grabs a weapon
- Shoots guy in head

Which is since I disagree with the verdict the jury was wrong. There was only one possible "real verdict" guilty.

Now imagine the comments of the two of you had someone been convicted and tons of TERBites had poured onto the board to denounce this travesty of justice.

It was a homicide, but not murder.

You're entitled to your opinion, but the Jury didn't even convict for a lesser offence, so their stance was that mens rea was lacking.

Seriously?
Yes you explain how is this person supposed to immediately replace it if they don't have lots of free cash and related to that only have liability insurance?

What you certainly seem to be saying is tough luck just wait for months for everything to be settled if it ever can be. You seem to feel it is all very simple it is not it is extremely complex.

Whether or not the guy is guilty and went overboard, here's a life tip:

In places like this where people likely have a high chance of owning guns or rifles (as opposed to a bunch of bankers living in a condo downtown), the last thing any idiot should be doing is provoking someone who likely owns a firearm.

It's not like that family seems like serial killers going around shooting anyone who walks by.

It seemed something freaked them out as a bunch of people were on their property in a fishy way and one of the guys tried to steal their ATV. So what happened is the guy grabbed a weapon and blasted someone.

Don't do stupid shit, and Gerald Stanley and his son wouldn't have reacted like this. They would have continued on building that wooden fence in peace.

Lesson learned.

Gerald Stanley's wife got the shit kicked out of her and ended up with a broken jaw. Was he supposed to just stand aside and wait for the RCMP to arrive, in rural Saskatchewan?
Can't find any news on Stanley's wife being injured. But there is a lot more to this story...

There is a bit more to this story. http://www.cbc.ca/news/canada/saskatoon/gerald-stanley-trial-lawyer-defence-case-1.4519655

He said he was fixing a fence with his son, Sheldon, 28, while his wife mowed the lawn. A vehicle drove into the yard. Its occupants appeared to be attempting to steal a quad ATV.
When they heard Sheldon yelling, the people got back in the car and reversed toward Stanley. Stanley said he kicked the tail light. The vehicle then drove forward, revving fast, toward Sheldon, who hit the windshield with a hammer. The vehicle then rammed into one of the Stanley family's unoccupied SUV vehicles.
He said he then realized he couldn't see his wife, and had a feeling of "pure terror" fearing she'd been pinned under the grey SUV. Stanley said he was going to look under the vehicle, but popped back up after it started revving again. "I wanted that car off," he said. Stanley said he reached for the keys with one hand, with the handgun in the other. Then the gun fired.
He said there was a rifle between Boushie's legs pointing at Stanley, but the farmer "wasn't aware of that."

The SUV driver testified the group had been drinking during the day and tried to break into a truck on a neighbouring farm, but went to the Stanley property in search of help with a flat tire.

Looks like the group was looking for trouble from the get go. And the fact one of them tried stealing the ATV means they "were still in asshole mode" whether or not they had a flat or not. And if one of them had a rifle, who knows what that intent was.

Was the guy justified blasting him? Who knows. Really depends on the situation and how feared filled he was defending his turf. By the sounds of it, there seemed be a ruckus and vehicles driving forward and back and ramming other vehicles, so it seemed like a hassle was going on. But how much of a fearful life or death situation there really was would determine whether or not Gerald was justified shooting.

The courts say he was. So unless an appeal says otherwise, that's the decision.

Never the less, a situation that had a lot of fucktardary going on.

What’s worth more? A human life or an atv?

This is why people like me are in charge of shit and people like you...aren’t.
