There is absolutely NO difference between how a guy judge and a lady judge will react to your friend.
Really? So why is there this constant push in society for more women judges to be appointed? If all judges would do the same thing, then why does it matter?

Who has the agenda?

(1) me:
-no kids.
-iron-clad prenup with his wife.

(2) father who is soon to be inmate in an Ontario jail:
-so poor he is living in his car

(3) judges:
-sentence a man who is so poor that he is living in his car to 60 days in jail for failing to pay support.

Thanks oagre for all the info. It was very educational. I gave my buddy a big hug b4 he walks towards the court. I see clearly now how the system works here. B4 this thread I see FRO as a collection agency and mean hearted people. Now I see them differently. Same with the judges. Donno about some lawyers tho..I mean some.. lol

Btw..My sister just opened up a hotel in Singapore and asking me to spend the winter there working for her a few months. Can I get into trouble if I spend my winter in Singapore working for my sister where they cannot garnish me. Do I have to inform them what I will be doing there and what my income is or it is better to pay them in advance ?

You can't escape support arrears. You should advise the FRO asap. Maybe they can garnish your pay cheque abroad or perhaps allow you to make a prepayment.

Someone who works with us pays child support only because he had no relationship with the mother of his child (so no spousal support). She's the primary caregiver. He's very well versed in the law, works hard and cares for his child on weekends.

That's wrong, and it all depends on who and why you chose this person to marry. My separation was very civil, no lawyers. Also given the fact that our daughter decided to live with her father. And there were reasons for her decision. Its not all black and white.

Thanks for the info re FRO. I have met some nice officers who has a good knowledge of me in my case but there was nothing much they can do. The only thing puzzled me was they say nice things and explained to me before they enter the court room but they acted completely different in front of the judges.

He was in arrear just like me. They are counting all the months he hasn't work and while on social assistant for a few months hence all piled up. But he was paying half of his income after he started working and nothing was hidden to the best of my knowledge but 50% of his income covers only about 40% of his spousal support judgement so it all adds up to 35k. There is nothing much he can do.. He is still sleeping in his car at Tim Horton's parking lot. He used to sleep near the Golf club where I hang out but police woke him up and told not allowed to sleep in public places. He owes a few hundreds to some of his friends.

So was my case. My judgement was $3500 a month cuz I was still running the business a few yrs back and she was living in a luxury house in prestigious neighbourhood. After I lost my business I couldn't meet my spousal support payment and was behind as well but managed to survive. Donno how long I can keep on working tho'. I cannot appeal for lesser payment either cuz they found about $40,000 cash which I failed to disclose when the bailiff seized my office for business documents. Her lawyer made up good stories I might have some more large sum of cash hidden some where overseas and such and the judge bought his argument.


Were there any additional consequences for your lying, attempts to cheat the system and reneging on your civic responsibilities?

What your friend needs to do is take the issue back to court. You can't just show up to court to meet FRO and just say I don't make X amount of dollars anymore. You need to get a motion to change the existing order. It's form 14. On that form you will show them proof of your income , through pay stubs and tax accessments. Onc they have established your correct income they will adjust your support payments according to your signed income statement. If u don't make any effort to change an order and decide you just don't wanna pay than a dead beat dad you are in they're eyes. They have an order with a specific amount that u have been ordered to pay and that's what FRO is doing. They are the go between the payor and the recipient.

So get the existing order changed ok. The courts understand people's lifestyle changes and orders need to be updated for that. It takes a bit of time but it must be done. Make sure you tell your friend this.

Nevermind my last post it's obvious they have found him lying so that's gonna be hard one to get passed. Your friend is stubborn and needs to pay. His children should be supported, period. Especially if he has the financial means to do it.

These days I'm not aware that there is a push to appoint women judges over men judges. The rest of your post has been discussed to death in this thread.
