Does anyone see this defense strategy working?

Love the comment of "they're all fucking short bus people".
Anyone who believes anything that comes out of Trumps mouth is definitely brain damaged but as a defense of not guilty, judges aren't going to fall for that.

We already have defenses of "what I said is so ridiculous no one would have taken it seriously" from republicans......... in response to people taking it seriously, so why not a Hanlon's Razor defense?

"Hanlon's razor is a principle or rule of thumb that states "never attribute to malice that which is adequately explained by stupidity"

My new fave is Giuliani's 35 year old son saying he has five decades of experience in politics.

These are not smart people so that guy's lawyer might be onto something about Trump supporters.

Ignorantia juris non excusat - or ignorance of the law is no excuse. So, while these people may have diminished mental capacity, they knew right from wrong when they took part in illegal activities. Plus, we've seen in some US States they will execute the developmentally handicapped.

So, no, this defence strategy will fail. The Shaman may be a moron, but now he'll possibly serve some jail time. Federal jail time, if I'm not mistaken. And in Federal court, the plea deals can be rough.

I don't think that that is their defense.

I think it is that he is so stupid, he believed what trump and QAnon were telling him, i.e. the election was stolen blah, blah, blah. They were patriots saving their country for the rightful president.

He's already doing pre trial time. Remember when he motioned the court because they wouldn't give him vegan food?

people can be found ncr(not criminally responsible). IQ is relevant as I have seen many retarded people commit crimes and been found ncr. does stupidity equal low IQ or mental retardation. that up for the crown, lawyers and psychiatrists to figure out.

Any judge that allows that would be run off the bench.

It would have to be extreme. Just being a fool or a guy w a grade 6 education isn't going to cut it.

It's indeed a weak defense, but what is the alternative, science?....

Fair point. But stupidity is not a viable defence.

The issue here is the Dems used this strategy as an attack against Trump
So it is a bit funny to see them using it as their primary Defence now

He got the QAnon Shaman a court-ordered psychiatric assessment, but I can't see how that's going to help him. Even if the QA S is dumber than a brick, he still knew that he was in the Capitol and that's all you need to make the charge stick.
