While what the cop did was wrong.

You got to know the you don't f*** with State Trooper. They aren't know for their sense of humor, tolerance or intelligence.

He deserved to be handcuffed, I'd have no problem with that either.

Whats scary is how quickly the cop resorted to his taser.

What if it had killed him, would it still be worth it???

I totally agree but I would just go along with the trooper. Worry about my rights later.

Trooper was clearly on ego trip but better to cooperate then the alternatives. (The trooper could have done others things too because the guy didn't cooperate.)

First off let me preface this by saying that cop acted like an asshole. The driver also should have had the common sense to realize you don't sit there and argue with ticketing officer. That said the driver clearly was headed back to his vechicle. The assumption is the drive was going to get back into the vechicle and leave. That would have resulted in a chase and possible endangerment of others.

Was the cop justified in using the TASER????
Fisrt question is should it have come to that in the first place. Personaly knowing the incident is on tape I would have marked the ticket that driver refused to sign and left him a copy. Radioed ahead and had the car stoped for 1 mph over for the rest of the day.

1) To my knowledge...and I've never been to Utah...no one can force you to sign anything. And I don't remember the cop telling him that his choice was to EITHER sign the ticket or be placed under arrest. Indeed, I have refused to sign tickets before...its to acknowledge receipt. Most places now don't bother...they just give it to you.

2) The guy DID look like he was walking away. Not fleeing in the bank robber sense of the word...but walking away, like "fuck you, I'm not going to stand here anymore". You don't get to do that.

3) He did get a warning...and APPEARED to me to be so caught off guard by the cops reaction that he couldn't get his brain to have his body comply...but was warned.

Summary thoughts...cops appeared to have escalated the situation with his attitude, versus remaining calm and explaining things ("I clocked you at ____ mph hour about 7 miles back...I really need you to sign the ticket else I am goning to have to arrest you...sorry...its the rules"), but once they GOT escalated, I am not sure he had much else in the way of available options.

Appears to be another classic example of how the police are not trained to REALLY deal with conflict...if the cop had just answered the guys questions about his speed and let him talk himself out, all could have been avoided.

I wonder what he would have done if the woman had not gotten back in the truck? Did I hear him threaten to taser the guy again?

He also reached in his pocket which was stupid.

Bottom line though, is it worth risking death by taser over a speeding ticket???
What if he had a medical condition and it killed him????

If he took time to read over what the trooper asked him to sign he would have known what he was being pulled over for.

The side of the road is not the place to argue with a trooper... For god sake don't get out of the vehicle without the trooper telling you to.

It my not be "fair" to the citizens but it is a good stay alive strategy.

Fascist pig. I wonder what happened in the aftermath, if the cop was disiplined or not. The driver of the car did not handle the situation very wisely, to say the least, but that does not justify the way the cop acted. He was on a real power trip. Probably couldn't get it up with his wife the night before.

A cop once explained this to me. Most people think a ticket is more of just a nuisance, but legally, it's more involved.

The ticket is, technically, an official notice that you have been accused of an offense.

Your signature is NOT an admission of guilt; it simply acknowledges that you received the ticket.

If you refuse to sign it, then you are refusing to be "accused" via written notice, and have, in effect, opted to be placed under arrest to be formally charged.

Whatever you say to the cop (i.e. play street lawyer) is pointless; you can only present your defense in court. In fact, "anything you say can and will be used against you in a court of law."

Technically, the cop was following the book. I agree that his taser use, and generally crappy attitude were questionable.
