All that paper trail shows is that you advanced money from your Line of Credit and that you made payments toward your Line of Credit; that's not a contract or a loan agreement.

TD doesn't care about this little arrangement you made with this woman. I don't know how much interest you charged this woman; but the interest that you have to pay to TD has increased significantly over the last year and a half thanks to the the Bank of Canada raising the Overnight Rate.

If she went to the Bank to get a loan, and the Bank turned her down before she came to you, there probably was a good reason for that....maybe she had a history of not making her loan payments on time??

Some the fight scenes went on a tad too long as well. Was so tired at the end of each day, and those fucking stairs were killer! :ROFLMAO: I may be the world's greatest assassin, but this was Chapter 4 and I ain't any younger, y'know? Felt good to finally sit down at the end ;)

OUCH!! Sorry and no offense intended but anything beyond a few hundred dollars, it's ALWAYS best to write up a loan agreement, especially since you said she's not blue chip material.

Well you may be right, but the TD transactions are from her TD account to my TD account. And from my TD account to her TD account. May not be a bloody glove for evidence but it does kind of show a back and forth. I never charged her interest.
You would have to go to court. That evidence would be used there. I believe you have up to two years to file. Or maybe that is just for physical injury I don’t know but I would look into that as well.

After judgement, if you get it - you do a garnishment and lean. That is a whole separate process.

If she claims no money - you can have her brought to court to testify on her finances, and she will be asked how she pays for shit like rent and bills so if she uses cash for those; she will have to explain how and under oath. I think it is called a declaration of finance or something like that.

Can a place like Alpine credit give her the money to pay you back so she carries her own loan - maybe but at this point I would stop trying to help and just focus on getting the loan back legally

Ya. She is meant to be coming to meet me on Monday. I haven't sprung my idea on her yet. It only jelled in my mind recently. When I asked her last week when she is going to pay me back and she said " I don't know" and then mentioned she couldn't go to the bank for a loan because she wasn't officially working I remembered the radio ads that were saying " own your own house? Approved!" that I checked into Alpine Credit. She has made well over $300,000 in equity on the property she bought so I'm not exactly putting her over a barrel.
I spoke to them on the phone and they said just fill in the online form and they would do the title search and whatever else. She didn't have to produce much documentation online for them. So I will try. If she doesn't go for that I will go for small claims.

Don’t let her off the hook what ever you do. She owes you this money. Fight for it and get it back. You get court costs too if you have to go that far.

Make sure you get as much of the issue documented in writing, even if it's text messages of them making excuses or empty promises.

File a statement of claim in small claims court, get a judgement, and slap a lien of their car or house.
take them to small claims court....what makes you think they will voluntarily take a loan to pay you when they don't even make an effort to pay you in the first place....unless you have the guts to take them to court. that money is long gone....

Quick update. I phoned her to set up a meet. She was in a lawyer's office freaking out because she got a text from the cops saying she was going to be charged with a fraud for 20 grand. She sent me a copy of the text from the cops with contact number and the officer's name.
so I went straight to the police detachment close to me and showed them the text. Scam of course. I phoned her back and told her so.
FAAAK. Always something blocking me in this shit. Just made my shaky resolve stronger. Something like Zelinsky must feel when he realizes what he's up against.

Sorry to say but that's kind of comical. LE would never txt anyone to tell them they're going to be charged for fraud. That she fell for it & went to a lawyer is kind of funny. Wonder how she'll pay the lawyer considering she's having trouble paying you for money you loaned her.
