Advice needed for employment problem!

First of all I am a Marketing and Sales person not a lawyer and I have been away while all this legal advice has been passed out. I have a couple of questions for you, assuming you still want to work with Smiles:

1. You have indicated that Smiles likes your work, have you considered approaching them directly and offering to work for them as either an employee or a contract worker. Would they consider it or are they tied to Scum?

2. You indicate you have set up your own company could you and your boss "reverse roles" such that Scum employs your company instead of your bosses and you in turn employ him? This would buy you another two years to convince Scum Canada to change their mind and save them the cost of training someone new while at the same time maintaining Smiles level of service.

If neither of these works then move on but train the replacement to the best of your ability. The old saying "What goes around comes around" applies a lot in business particularly in a specialized area such as yours. I personally know of at least two instances where people burned bridges only to apply later in their career for a job and find the person they burned in a decision making role. Needless to say they didn't get the job even though in one case they were far and away the best candidate.

1. The way the company is structured, they wouldn't need me as they have a 7 year contract with Scum for all network administration. I wouldn't want to work for Smiles in any other capacity, I hate the thought of being chained to a desk. For any other LAN admins out there, you know how much freedom you have especially when you work in multiple offices.

2. I tried arguing that point, but Scum said that although I never had a direct contract with them, my name exists in their database so that option is not possible.

I will try to find another position or expand my own pc/network business. If I need the money, I'll ask for double my rate to train and do so (but I'll be selective in how much training I will do, don't want to tell the replacement all my secrets).
