“I hear someone say, ‘Guys, there’s a naked girl in the bathroom,'” said former team member Tyler Steenbergen, who began his testimony Wednesday at the trial of five former teammates charged with sexual assault stemming from what happened in McLeod’s room in the early morning hours of June 19, 2018.

“I was kind of shocked,” he said. “And then she shortly after came out.”

The woman was “unclothed,” he said. There was a bed sheet on the floor between the beds and the woman placed herself on top of it.

“She went on the floor and started masturbating and then asked guys to come over and have sex with her,” he said.

Assistant Crown attorney Heather Donkers asked Steenbergen exactly what the woman said. “She said, ‘Can one of you guys come over and f— me.'”

Still a lot more information to come out of this but saying that the crown has a solid case at this point is putting the cart before the horse

The testimony is consistent here as verified by the text messages.

That’s wrong…the video was taken after the other players had sex with her.
The first video was taken at 3:25 am where someone asks are you ok with this? To which she replied yes I'm ok. She was sitting on the bed fully clothed and unaware she was being filmed.
Is it your contention that they had already had group sex with her before this was recorded? If you are right its not consent. But I don't think you are right. I think the acts took place between this and the 2nd video at 4:25 am.
The 2nd video was taken at 4:25 where she states while only covered in a towel "this was all consensual. I enjoyed it. Are you filming this?"

This is the timeline I've been able to find

1:30 am McLeod and the complainant E.M. leave the bar to go back to his hotel room.
1:45 am Mcleod and the complainant arrive at the Delta Armouries Hotel
2:12 am McLeod sends a group text out asking anyone down for a threesome? Carter Hart immediately responds saying yes.
3:00 am McLeod goes to the lobby to pick up a food order
4:45 am E.M. leaves the hotel

The witnesses are delivering sworn testimony. Under a microscope. Why would they risk perjuring themselves if they aren't the ones charged?

If K Douglas' timeline is correct, EM would probably have eaten something in between the two phone videos. This would likely impact her level of intoxication at the time the second video was recorded. I believe that she said something about eating nothing that evening. Perhaps the food delivery guy is one of the defence witnesses.

Being teammates doesn't necessarily make them buddies. If you have proof that Tyler Steenbergen is buddies with any of the accused I'd like to see it.

If this were true, why would she agree to testify at this trial? For MORE humiliation? She's already been paid, and she chose not to bring charges forward at the time. We're what? 8 years later? Her financial situation is light years ahead of all of the accused. She has nothing to gain from this trial, except justice for a crime she believes was committed against her.

Read the criminal code and supreme court decisions. As a matter of law, consent gained under duress or intoxication is not consent. Consent for 1 act is not consent for all acts.

Finally, we're not even through 2 witnesses in of 40 scheduled.

There is already evidence of collusion after the fact
There are already inconsistencies in the story "I thought there was food" vs. "hey guys who want's a 3-way", "we came for food, and a naked girl showed up", etc.
And there is already evidence of 2 non-consensual acts: Butt smacking and the splits.

Add spitting on her, and the dude that brought her there in the first place, and we're already at 4 of 5 with a probability of conviction.

Carroccia’s decision to discharge the jury was made following legal arguments by the Crown and defence held without the presence of the jury on Thursday afternoon. With the jury now dismissed from the trial, the details of the arguments can be reported on.

The jury was dismissed after one juror, in a letter to the judge Thursday, complained they and “multiple” other jurors felt “judged” and “made fun of” by two defence counsel.

The juror alleged that the defence counsel for Alex Formenton watched and whispered to each other when the jury entered the courtroom each day. The complaint alleged the two laughed with each other as if they were discussing the appearance of the jurors.

The juror claimed the conduct was unprofessional and unacceptable. Formenton’s lawyers denied the allegations, Justice Carroccia said.

In a decision delivered Friday morning without the presence of the jury, Justice Carroccia said “negative feelings about counsel might impact the jury’s perception of the accused” and that the “fairness of this trial has been compromised.”

Formention's lawyers have caused 2 jury's to be dismissed. It's a bold strategy. Hopefully the Law Society doesn't come after them.

Now it may go to just strictly law…might not be good for the players, as example, if we were the jury there are some that think guilty and others that say not guilty, now it’s just the judge…lawyers are gonna have to work even harder

With a jury, there's a good chance of getting a church lady juror who thinks "sluts get what they deserve" or a sexist guy incel juror or simply a jealous bitch female juror who hates other women.

Now they just have a judge who is none of those things.

Both lawyers have emphatically denied they made any such comments.

Daniel Brown and Hilary Dudding released a rare statement about the allegations right after the judge dismissed the jury this morning.

“In short, a juror came to somehow believe that our courtroom demeanour was disrespectful of her. This was an unfortunate misinterpretation,” the pair said.

“No defence counsel would risk alienating a juror, and nothing could be further from the truth in this instance. While it is true that co-counsel will speak with one another from time to time during a trial, this is commonplace. The very idea of counsel making light of a juror is illogical and runs directly counter to our purpose and function,” they continued.

During yesterday’s discussions about how to move ahead with the trial, Brown also expressed that the allegation would be sure to have a “chilling effect” on the defence teams’ ability to effectively interact with the jury.''
