No they are legal even when their case is being heard.
When their case is approved they become permanent residents from their previous status as asylees.
That's how it works even here in Canada.

You can't even get a flight going to Canada if you don't have a Visa, no airline would let you get a flight....in the US, you are detained to a facility until a judge grants you papers - making you legal. Only the Biden Admin allowed undocumented to enter freely...

For Canada you have to present at a port of entry and apply for asylum on arrival.
In the US you are detained and then removed if you dont have an asylum case, and if you do, you are released on parole, and asked to appear in immigration court.
They are legally being allowed to enter the country, and are subject to a legal process and hence they are legal immigrants.
The ones who are illegal just escape all scrutiny.
