This is the whole point.

The EO about birthright citizenship is blatantly unconstitutional and will be overturned. But it will be spun on Fox as "the radical leftists" creating chaos by overturning the president's work.

It's about creating fake fights that can then be anger-farmed and milked.

He should have 3, probably has 4. Five is trickier on that.

But that's the kind of thing that exists to be selectively enforced anyway, so it will be years before the Supreme Court would weigh in on it and you can use it to fuck with people freely before then quite a lot, which is the point.

Thomas is a guaranteed vote in favor of taking away birthright citizenship.
I'd say Roberts, Barrett, and Gorsuch might be questionable. (I would have to look at Gorsuch's history.)

Especially if the EO stays in this form, where it is just applied to babies going forward.
(It's written in a way to be somewhat vague, though, and I see no reason it will remain limited.)

Here are the reasons that the USSC won't let it stand.

1. It's a firm, very clear decision that has stood for 100 years. (And it's not ideologically driven like abortion)

2. It's 1 thing to let Congress overturn precedents after debate. It's quite another to let EO's attack long-standing constitutional precedents. You begin with this piece of shit and you'll have 2-bit GOP asswipe governors in OK and AL overturning Miranda and shit like that. The entire constitutional structure of the country will fall like a house of cards. And then the Dems can do the same shit back in their states.

This court has already established it doesn't care one whit about whether or not a decision is clear or has stood for a long period of time.
Also, this is extremely ideologically driven, as immigration is a major political issue with a strong ideological component.

Who cares what the asswipe governors say. They can't do nationwide executive orders, they aren't federal executives.
