GRAND HAVEN, Mich. — A judge ordered a western Michigan couple to pay $30,441 to their son for getting rid of his pornography collection.
U.S. District Judge Paul Maloney's decision this week came eight months after David Werking, 43, won a lawsuit against his parents.
Maloney ruled in December that Werking's parents had no right to throw out their son's collection of films, magazines and other items. Werking had lived at their home in Grand Haven, Michigan for 10 months after a divorce before moving to Muncie, Indiana.
Werking previously estimated that his collection was worth $25,000, The Holland Sentinel reported. According to emails between Werking and his father, the collection included 1,605 individuals titles of DVDs and VHS tapes.
Werking's parents were unwilling to transport the collection to their son in Muncie, and they were uncomfortable with having the items in their home, according to the Sentinel .
After moving to Indiana, Werking learned that his possessions were missing.
Maloney in December said, "There is no question that the missing property was David's property.
"Defendants repeatedly admitted that they destroyed the property," the judge confirmed.
Werking's parents previously said that they had the right to act as his landlords.
The judge followed the value set by an expert, MLive.com reported. Werking's parents also must pay $14,500 to their son's attorney.
“Frankly, David, I did you a big favor getting rid of all this stuff," his dad had said in an email.
The Ottowa County Sheriff's Office in Michigan reviewed the material and determined that the collection does not include any child pornography, according to The Holland Sentinel.

But he must have had so much time on his hands to want to watch around 1605 porn videos. We have all possessed some porn videos that none of us probably have any sentimental attachment to them. Sooner or later they do get dumped as there are many more recent free porn movies available online.

They still had no right to destroy his property. Kick him out, yes, but not dispose of his belongings.
Can you imagine moving in with your parents for a few months after a rough divorce while you get your affairs in order, only to have them destroy your TV, your computer, your phone, your car, and other assets amounting to $25,000 worth of property because they don't approve of your lifestyle?

Fuck me, though, how much space does a $25K porn collection take up??? Put that shit in storage next time, buddy.

Basically, this is a property dispute. What if they admitted they destroyed his complete collection of mint unopened Beatles and Rolling Stone albums. They would have to pay the value of the property missing or destroyed.

The contents have to be declared if you need to insure the goods being shipped out, especially if there are valuables as well. Can you imagine the embarrassment to the parents if for some reason there are damages to the cartons with all those porn tapes being exposed? Since when was the landlord responsible for you leaving your belongings behind? No wonder his marriage broke up as he probably spent all his spare time watching those tapes rather than having sex with his wife. LOL!!

The landlord has no right to touch any of the tenant’s property. They should pay whatever the court judges them to and all fees.
The son should have been notified and if he didn’t respond the property could have been boxed and stored at his cost. A third party could have handled the move if they don’t want to handle it.
After this is over the parents are free to fully cut him out of their will.

Yo will be surprised but landlord is responsible for belongings the tenant left behind. In Ontario, he must contact the tenant and wait a reasonable time for him to collect them. If no contact was possible, the landlord must either store them (and try to collect the storage costs from that tenant), or, after a certain period of time, sell them off at the best price he is able to, reimburse himself for any costs incurred, and send the rest of the money to the former tenant.

Then you made the point, about "selling them off at the best price". Can you imagine the parents displaying the porn videos at a garage sale. By the way who in their right mind would sue their own parents who have brought them up through thick or thin in life? Prior to this lawsuit I am sure that this individual would have been the beneficiary of his parents inheritance including their house and savings.
