I don't think the POTUS did believe her, but he was hoping the courts did...Trump was trying to steal the election.

In general, the defamation laws in the US are the same as here... the bigger the lie, the bigger the award of damages... and if she knew she was lying when she said what she said, the jury can award exemplary damages... and in the US, the damages awarded in defamation cases are much higher than here.

Her defence helps the plaintiff much more than they help her...

Carlson and Powell are very different situations for the purposes of defamation claims...

As the judge in Carlson said: "Carlson's statements were not statements of fact" and the plaintiff "failed adequately to allege actual malice" and [I think wrongly, because it is a question for the jury, not for a judge to decide,] "given Mr. Carlson's reputation, any reasonable viewer arrives with an appropriate amount of skepticism about the statements he makes."

It would be a very odd world if a lawyer gave a press conference about the facts which she claimed to be able to prove in a high profile case which was about to be argued and then took the position that it was a mere expression of opinion.

I could give a press conference, allege that the opposing party raped his 8 month old child and that I intended to prove that in a trial in a week's time and then make no attempt to prove those facts and subsequently take the position that my out of court rant was so extreme that no one should believe it and I am immune from a libel claim.
