None of our esteemed lawyers seem willing to answer the question: Is it not the intent of the second amendment to allow citizens to take up arms against their government if the feel it does not do a good job for them?

God forbid.If he used automatic fire that likely saved many lives. It's inaccurate, he would have almost immediately run out of ammunition, and while he was reloading people would have run for cover. Much more dangerous if he had been aiming single shots.

To possess an automatic firearm in the United States you must have a license from the ATF, these are not issued with a generous hand, require a full background check as well as payment of substantial fees, further the hopeful owner must have their local police chief or sheriff sign off on the license (and they can refuse to do so), not least the U.S. National Firearms registry (NFA registry) was closed to fully automatic firearms in 1986, therefore only holders of a U.S. Class III Federal Firearms License (and these are not common) or a police agency may legally posess a post-1986 full automatic firearm.I don't think we can conclude what kind of weapon it is just yet. He was from Illinois which prohibits automatic weapons. But several articles said he was recently living in Virginia which allows automatic weapons.

However apparently it's easy to convert a M4 to full automatic. The needed parts can be easily machined in a basic machine shop or bought on the Internet under guise of other products. Add to this that James Hodgkinson has a criminal history and for all of these reasons it is about as certain as anything can be without an official statement that it was a semi-automatic firearm.
