The motorcycle driver.He did not even stop when he approached the road. It was not a proper intersection where the driver would expect any traffic. The reason why dash cams are so popular is to determine responsibility and even to avoid negligence charges and spend time in jail.

Ordinarily, it would be the motorcyclist since he did not yield the right of way to thru traffic, however, was the car driver on the wrong side of the road, or is it the left lane for that particular country?

Assuming the car driver was supposed to be in the left lane (looks like it based on the cars coming the other way doing the same, and note which side the driver exits the other car at 45s) the moped is 100% at fault.

I had an instructor from England that had been living in Spain for a number of years where they drive on the right. He went back home for a visit. He made a turn into a car park (parking lot) with a divided entrance. As he entered the lot, a car was coming out on his side. He rolled down his window and started bitching at the other driver until he realized it was he that was in the wrong. Any time I am any where, where they drive on the left, I leave it up to the professionals. Especially places like the Carri bean.

The bike is 100% wrong. No other way to look at it.

And yes, when in the Caribbean, I want nothing to do with driving on those roads with those drivers.
