The hotel is only on the hook for half. The other half is coming from the peeper, but obviously he isn't going to have it. She will get his house and whatever savings he has and then he's going to declare bankruptcy.

I think she will eventually get a big chunk of what the hotel owes. It's going to take time but it's big enough her lawyer will work for free until she gets paid then take his cut, she won't have trouble keeping legal fight going.

The first appeal will be a real fight, there will be some legitimate arguments to hear and that will drag out awhile. If the hotel loses the appeal and then does what you imagine after that, just going to court for no it frivolous reasons, the judges will see that as egregious and start awarding her legal costs and it'll get veeeeeeery expensive, very quickly, for the hotel.

Most of us I doubt would find it an egregious award if it was our sister or daughter who was involved. The case facts here were that the hotel was negligent in allowing the filmer to book a hotel room directly next to hers they also apparently had no hallway security to see him fiddling with her room's peephole. The only good news for the hotel is that in Tennessee defendants are only liable severally (hence Erin Andrews cannot make the hotel pay the whole judgement and leave them to pursue Michael D. Barrett for his share).


Fault was found to be: 49 percent with the hotel ($26.75 million), while Barrett the convicted stalker, was found to be 51 percent at fault ($28.5 million) hence it is likely that she will receive but in the range of $27 million out of which will come her attorney's fees.


This episode really shows an amazing lack of basic common sense on the part of the hotel. Unless the person is a very frequent guest at a hotel or they were booking the penthouse, when was the last time you asked for a specific hotel room by number as opposed to a certain side or floor of the hotel.

When I use to frequent NYC I always ask if my favourite room is available.

One time I stayed at a different hotel (owned by Hemsley?). I woke up in the middle of the night because I had to pee pee. As I made my way from bed to bathroom I saw someone else in the room. I asked: "Who are yo? What do you want?"

The entire budget for assisted living facilities for elderly people in the City of Toronto is less than 55 million. The budget for the hospital care for Vetrans in Toronto is less than 55 million.

So tell me, is getting filmed in your birthday suit worth more than all of that?

We wouldn't get this amount but part of the reason the video is popular now and will remain popular is her celebrity status. This will be with her a long time and the stupidity of the hotel to confirm her room number and put this stalker beside her is beyond stupid - she could have been killed so I have no sympathy for them.

Half the amount is owed by the guy in jail, her lawyers will take ~30-40% and she will be taxed on the balance so the amount actually in her pocket will be substantially less than the total awarded.

I'm with you. Ya i'd be pissed if my daughter, sister, or girlfriend's privacy was breached like that & the sick fuk that filmed it should have 10yrs in the grey bar to set an example. But 55 million give me a break that's just ridiculous. She's got a decent body & she's not exactly hard on the eyes, embrace it honey take a few mill & move on. If I recall there's only been a handful of women that graced Playboy that ever commanded seven figures. So a few mill for a crappy keyhole video would be all she'd be getting awarded if I was the judge & that's being generous.

In the US, damages are set at a level that will drive change. Same reason why that woman who spilled McDonald's coffee on herself got a mind boggling amount.

Half of 55 million is the amount it takes to make the hotel industry sit up and listen. If she had been awarded a hundred grand they would just write it off, and change NOTHING about the way they do business.

Other than a momentarily lapse in judgment what did the hotel do to be hit with a $27MM penalty? Escorts have been murdered in hotel rooms, is that the hotel's fault as well?

That momentary lapse is the result of their failure to train staff on procedures to protect the privacy and security of their guests.

Not really. It's an extraordinarily high verdict, one of the highest ever in that State.
The Tennessee court of appeals could reduce the amount, or maybe even send it back for a new trial

When all is said and done, she will not be getting the$55 million. The hotel will fight like hell to keep their money and not set precedent, the perp has no money and her lawyers will get a huge chunk.
