I was told by Canadian Airport Customs that they don't care if you are there to see an escort. This was after I didn't give a sufficient enough answer in the customs agents view as to why I was visiting Toronto. In Montreal they are much less anal and don't question that you are there for a good time. At a US border crossing after being detained for a half hour by a couple of clowns playing good cop bad cop I admitted that my trip to Toronto was to see girls and they told me I should have just said that in the first place and they let me go. They treat you with the assumption that you are going wherever to do something illegal. Bunch of dick heads.
The US side will have a major issue with an alien trying to enter the US with the intent of seeing escorts. I'm guessing you're an American hence the reason they didn't make an issue out of the fact you went to Toronto to see an escort. It's not like they can ban you from returning to your own country.

Exactly. I will fess up and reveal what my searches were about. I had searched prostitution laws in other countries. I was curious about the laws in other countries. Showing an interest in ravelling to other countries for the purpose of having prostitutes? I probably would have been detained at the least.

But just because I search something that may be illegal doesn't mean I committed any crime. I should be free to search anything I want..

Coming back to Canada always seems to be a bigger headache than going to the US.
Forgive me since this is based only on my experience, but, I've found that female guards always seem to have something more to prove when compared to their male counterparts. I now have this dread whenever I pull up to the booth and see a woman there.
I have found the same thing myself in particular with female Canadian cops and customs. Once I made the slip of the tongue and called her "sir". That was the start of a long delay.

Doubt that would work. They will keep your laptop and more than likely you in a holding cell. They won't give a rat's ass who has the password because the laptop was with you and is considered yours.
It would be the equivalent of saying your buddy packed the suitcase that they found drugs in. They won't arrest him, they will arrest you
I agree that they could keep your phone and hire a hacker to unlock it somehow later. You will only attract more suspicion.

One of the leading experts on computer security. He literally wrote the book(s) on cryptography and the internet ("Applied Cryptography", "Cryptography Engineering") as well as several others on security (" Beyond Fear", "Secrets & Lies", "Liars and Outliers").

That method of transporting password encrypted electronic data in a way that is safe from coercive tactics against the traveler is due to him. I believe he made it up in a blog post.

He has an interesting blog: https://www.schneier.com
That is true once you cross the border but before they grant you entry to the US you are in a no man's land where you lack these basic rights.

Thanks for the info.

I have a friend who never has a problem but he works for TI and probably has a Nexus card.

The National Geographic channel just ran a marathon over the Canada Day holidays for the show Border Security which shows the Canadian Border Security Agency (CBSA) in action. It was a real eye opener. One of the first things they go for when they're questioning someone is their mobile phone so they can read the person's texts and emails. They busted countless people by finding incriminating emails (which basically revealed why people were really crossing the border). Another guy had a portable hard drive and they searched that image by image looking for bestiality or child porn (they found the latter); they didn't seem to care about regular porn as they pointed out that it's legal. One person had no texts and the guards were immediately suspicious, saying to the camera "Who doesn't have any texts on their phone?" Often they would take the person's devices and disappear into a back room where they'd do a thorough search.

They never showed them asking for a password so either they edited that part out, there were no passwords on the phones, or they broke the password in the back room.

It was a real eye opener for me and I've started to go through my phone to see what needs to be deleted next time I cross the border. If you're going to the US (and even to Canada if the new law passes), anything that hints of soliciting prostitution can get you barred and possibly even banned for a period of time. The US has a "moral turpitude" classification that basically says if you've been involved (charged/convicted) of anything to do with violence, drugs, or sexual crimes then you're inadmissible without special permission. I strongly suspect solicitation would fall into that classification.

For all those people waving their rights around and saying use this or that encryption, yeah, good luck with that. At best the CBSA will just send you packing back where you came from but far more likely is they'll hammer down on you and really make your life miserable. Oh yeah, and put a big honking red flag on your file for every future time you try to cross the border. So go ahead, try to play philadelphia lawyer or cyber guru. Just make sure the Border Security show is filming cuz I want to laugh at the hell they put you through.

You don't even need to be charged or convicted of something to do with drugs or prostitution-related offences. People can and have been barred from the US for so much as admitting to having tried marijuana at some point in their youth.

Generally speaking I find the US side is typically friendlier and more reasonable. I remember one crossing where the US CBP lady was actually flirting with me, it certainly put a smile on my face. On the Canadian side the hardasses are typically women or the very young. CBSA seems to have a thing for hiring people who look fresh out of high school or angry fat women who get off on trying to make you appreciate how mighty and oh-so-powerful they are. The seasoned vets usually aren't into games or being pricks for the sake of being pricks.

I normally try to avoid the younger female CBSA agent if I can choose a lineup. They are the ones who tend to have a massive chip on their shoulders. Once, one of these sent me to secondary for some trivial reason (I don't remember). The agent there looked at my card and asked 'why are you here?' I said "I dunno!". He said 'get outta here!"

It's much worse than that. The border guards have COMPLETE discretion when it comes to deciding whether to let you enter or not. They can turn you away because they don't like the look of your jib. Hell, they can turn you away because they feel like it. That's the least of your problems. Many of the people on that Border Security show are allowed to voluntarily withdraw their application to enter the US. The alternative is the border guards put a restriction on you that bars you from entering for a period of time (normally 1 year but can be anything from 10 years to permanent). I suspect someone just being a dick is going to get his knuckles wrapped if they bar you for no reason at all but the point is it doesn't take much for them to make your life hell.

There were people with DUI's who they said are banned for 10 years unless they get a special exemption. There was one guy from New Jersey who had been convicted of drug distribution who was an outright and permanent ban for life (no special exemption there).

The one thing people have to remember is that you have no right to enter another country. If they don't want to let you in, they won't.

True, but soon if not already, these rules will apply to crossing over their airspace. Then what? Leave Canada or become a shut-in? Buy a boat?

The solution is simple

Do not go to the Fragmented, Paranoid and Militant States of America.

There really is no reason that you MUST go there, so screw them and their police state antics.

More to the point, I'm ok with a society where people who think along those lines are stopped at the border. Sure, all you're hiding is nudey pics, but what about the next guy?
I too don't have a problem with the CBSA or others hunting down child porn and drugs either.
Elise, you should have a problem with it.

As DB suggests, the justification for giving border guards the authority to search without cause is because that might be the only way to stop a terrorist attack. Many say that the need to snag a terrorists' comrades even justifies torture.

But you want to use the border guards' special powers to combat child porn, and drugs? Presumably you would also include murder, rape, kidnapping?

In fact, think of all the unsolved murders and rapes that could be cleared up! Why don't we give the police unlimited power to go into people's homes and search anyone, anything, anytime? I don't know what is the murder, rape, etc rate in North Korea, but I'm certain it's a great deal lower than it is in countries where the police need a warrant to search for evidence for those crimes.

You should get into politics. With your casual disregard of basic human rights, you should fit right in.

CBSA cannot refuse entry to a Canadian citizen. Once you have proved your citizenship (passport) they HAVE to let you in no matter how uncooperative you are. The only question is how much duty you owe.

Now a Canadian trying to enter the US is a different situation, no right to enter. But still the guards are subject to regulation. They cannot refuse entry just because you refused to give a password, they have to have to cite a specific regulatory clause in refusing you.

Other, non democratic countries might be a different story.

So can we get the facts straight. Is having been on TERB illegal. Having normal porn pictures(porn is legal) a problem. Having made contact with an SP or MPA illegal.

I am talking about having evidence of this activity while in Canada?

Wouldn't having most porn pictures technically be considered piracy?
Either way, I would just offer them a copy and they would send me right through :)

Being on terb is evidence of criminal activiity, as they can search your posts and see that you have engaged in prostitution, which is a crime in the US.

Having porn with images/videos of young women could lead to serious problems. Some images contain actual minors that you may not know to be minors. Or there may be images of adults who look to be much younger. Since there is no way you can prove that these women are 18 or over, you could be facing child porn charges. Once that happens, it's game over. You will be arrested on the spot, your car seized, and you will be arrested. You will never cross the border again, and you will never find a job again because employers will see your criminal history.

Yeah, the one that gives them discretion to refuse you entry as being an undesirable. Your Philadelphia lawyer beliefs won't protect you if the border guards want to deny you entry.

Oh, and you think you're safe as a Canadian coming to Canada? Wrong again. They can make your life miserable for hours on end, rip apart your belongings, red flag your passport on the system, report you to the Americans, and only then, if they haven't found anything remotely criminal to charge you with, will they allow you to enter Canada. Yeah, that sounds like good advice to give people!

Whether its illegal or not isn't your only problem. If they're convinced you've been engaged in illegal activity they can ban you outright. But they can also do so if they believe you're an undesirable entrant to the country and/or suspect you might be engaging in criminal activity.

If they see you're a member of escort sites, big red flag.

Legal porn is another red flag for them. It will likely cause them to look deeper into you to see if they can find anything else. Probably not as big an indicator as TERB though.

Remember, not all border guards are dicks and if you're cooperative your chances of entry go way up. But if you pull a Fuji and start trying to play Philadelphia lawyer, they'll fuck you so hard you'll be walking funny for days.

That Border Security show had lots of people who tried to play Philadelphia lawyer and every one of them got fucked in the ass. The guards know the ins and outs of the rules far better than you do so be forewarned.
